Hospital told police patient not raped because attacker transgender

A hospital told the police that a patient could not have been raped because her alleged attacker was trans, the House of Lords has heard.

The attack took place a year ago and the woman reported it but when officers contacted the hospital, which has not been named, they were told “that there was no male in the hospital, therefore the rape could not have happened”.

Baroness Nicholson of Winterbourne, who raised the issue during a debate on single-sex wards, continued: “They forgot that there was CCTV, nurses and observers.

“None the less, it has taken nearly a year for the hospital to agree that there was a male on the ward and, yes, this rape happened.

The people who facilitated this happening should be charged under the joint enterprise law. Might start making them think twice.

If trafficked women who are forced by pimps into finding other victims are charged under that law (and they have been) then the people who made sure this poor woman (and potentially others) was an open target for this hideous man should be charged too.

As "people with a cervix" has been deemed ok, why was 'person with a penis' not used in this situation?
It seems that describing a person by their genitals only seems to be accepted when it's about females.

I can't understand how the hospital managed to get in the way of the rape investigation anyway. Surely even if there were no officially "male" patients there could have been an intruder. The details of who the attacker was seems secondary to the fact that it took place.

This case is appalling and I hope the victim now gets justice.

I also think that a trans person that does something that is solely possible due to their birth biology is not meeting the criteria for living as the opposite sex. They cannot claim trans status then act in a manner that is biologically impossible for the sex class they claim to identify with.

This has just about broken me. I'm a frequent hospital patient and I know too well the sheer vulnerability of being in a hospital bed. Thinking about this poor woman, raped and then gaslighted, just sickens me to the absolute core.

Just can't do this anymore. I feel helpless. When will this end?

I am possibly more open to the idea that TWAW than most on this thread. However, anyone who chooses to use their male organ to perpetrate an unspeakable crime is - without any question at all - not a TW.

The same goes for TM who give birth.

Well we are either saying TW can be rapists or that men pretend to be trans women to rape

Both make the case for single sex spaces

But if you look at the stats at the moment TW are at least as likely to be rapists as other men are, and potentially more likely if the statistics for TW sex offenders are accurate.

Presumably Stonewall, Gendered Intelligence, GIRES , Mermaids and and all the other gaslighting organisations will be evident influencing this hospital and all the others with policies about sex offenders being placed on women's wards.
Does nobody in the NHS ever challenge these people? Imagine sitting in a meeting and discussing whether it's right for male born paedophiles and rapists to be on a women's ward - let alone to actually decide "yes it is" Shock

This is absolutely disgusting! That poor woman. I don't often post but I just wanted to say one thing. I know, you know, the hospital knows, the nurses know, the victim knows, the police know, the trans person knows, society knows - no matter how we frame it, we all know the truth. Why are so many people complicit in denying the actual truth? What is wrong with reality?

Trans people are entitled to feel as they please but when it comes to a rape we cannot deny that this trans woman has a penis and has used it to rape a woman. We can't protect a trans woman's feelings over a biological woman's physical rape. This nonsense has to stop. I'm so angry!

The hospital should definitely be named. Why the fuck do they get to keep anonymity? EVERYONE should be aware of which hospital it is that's done this.

anon666, I agree, I can't square this. So it was reported at the time, police contacted the hospital, were told 'there was no male in the hospital, so this can't the have happened', and what, just went away again? Surely they had at least a statement from the woman contradicting this idea that it 'didn't happen'?

'We submitted Freedom of Information requests to the Ministry of Justice.

It said that 60 of the 125 transgender inmates it counted in England and Wales were serving time for a sexual offence.

This is roughly half - but it's not the full picture.

Remember - those 125 transgender inmates only include people who have had a prison case conference. It won't include transgender people who haven't identified themselves to the prison service or who already have a gender recognition certificate.

Of the 60 serving time for sexual offences:

27 were convicted of rape (plus a further five of attempted rape)
13 were convicted of possessing, distributing or making indecent images of children
13 were convicted of sexual assault or attempted sexual assault
Nine were convicted of causing or inciting a child under 16 to engage in sexual activity
Seven were convicted of sexual activity with a child
Seven were convicted of indecent assault or gross indecency

Those numbers add up to more than 60 because some prisoners are serving time for more than one offence.

We don't know the gender of the victims or perpetrators in these cases.

The Scottish Prison Service says the 17 trans prisoners it counted were serving time for a range of crimes, including some sexual offences. But it wouldn't tell us precisely how many had been convicted of a sexual offence.'

If the perpetrator a penis the this crime is possible. Any unsolicited sexual activity without consent is criminal.
Is the defense against rape now that you're trans so it's not possible to violate a woman and rape her.
This gender/sex thing is insane, even the party leadership in opposition are too scared to define a woman.
The world has gone mad meanwhile this poor lady can't even get acknowledgement that the crime happened let alone get justice for it!

IMO it simply shows your background. Educated individuals would be fully aware of the underlying anger surrounding the reporting of the incident, without the need to remark on it in base language. I doubt the police, hospital staff or reporters used such language at the time it was being discussed between those involved, leastways not in public, and this is a public forum. I doubt whether the victim herself used such language to the nursing staff or police when reporting it or indeed the nursing staff reporting to police. .still, there's no accounting for low language standards nowadays on these sites.
