Hospital told police patient not raped because attacker transgender

A hospital told the police that a patient could not have been raped because her alleged attacker was trans, the House of Lords has heard.

The attack took place a year ago and the woman reported it but when officers contacted the hospital, which has not been named, they were told “that there was no male in the hospital, therefore the rape could not have happened”.

Baroness Nicholson of Winterbourne, who raised the issue during a debate on single-sex wards, continued: “They forgot that there was CCTV, nurses and observers.

“None the less, it has taken nearly a year for the hospital to agree that there was a male on the ward and, yes, this rape happened.

I can not begin to imagine the victim's suffering. I can't even make myself read it. As a nurse, I can also imagine the threats and brainwashing that some staff will have endured, within their organisation. 😢

I know I total agreement with you. Sorry I did not make my point very clear. I’m fed up with the twisting of truth that for all the men who say they are women within the justice system they are men and as a result the state of affairs is being massively misrepresented.

What I don’t get is that of anyone told me that a woman had been raped at my place of work I would do my utmost to help in any way I could. There was a decision made about this, given that there was CCTV and the nurses knew there was a male on the ward, they couldn’t have failed to know.

It’s sickening.

I feel so much for this poor woman, to have been assaulted and then gaslit. This is what feminists have been warning about and it’s far from the first case. There really does need to be clear legislation around this. Single sex spaces must be reinforced.

You can't assume that a male who does this is not genuinely trans. Trans is an identity and so you can rape away and still be a genuine transwoman. It's not helpful to suggest that genuine trans people don't rape

This is one reason why I now believe that there is no place for any male in female-protected spaces. I also believe that all female-protected spaces were set up as just that and not as spaces protected by identity.

Yep. Stonewall wanted 'acceptance without exception', meaning that anyone who says they are trans is trans. They don't lose trans status just because they've committed a crime, etc. On that, I am in agreement with them.

It's not necessary to believe there was a male present, that's irrelevant to the law. For it to be rape there only needs to be a penis. B

OP There has been another related thread on this, and it includes the Hansard report with Baroness Nicholson’s speech (where this rape was detailed). That Hansard link includes the other speeches too. Lord Etherton’s in particular is of note where he refusing to see a reason for amending annex B which tells hospital staff to lie about trans people on a ward.

In the light of the outrage over this - please consider writing to your MP in England over the flawed reviews of single sex spaces in the NHS.

I posted about this in activism a few days ago.

We need to protest this. Really raise the temperature (and not just on twitter).

I am furious and sadly unsurprised. I would like this to be brought up at the PMQ's - I want to see both sides squirm in their seats and condemn this.

If a doctor or nurse cannot tell the biological difference between a male and female they should have their medical licence revoked. If these “medical professionals” don’t have the first clue on basic biology then they have no place treating patients.
Makes me wonder what else they don’t know.
