Man cleared of rape because he was too drunk to realise which bed he was in.

Sorry DM but here.

This guy's girlfriend refused sex, he stumbled into another room "by accident" and started having sex with the woman in the bed there.

He was cleared of rape.

There is so much wrong with this that I don't know where to start. I imagine he's been cleared because he didn't intend (apparently) to commit a crime. But the fact is that neither woman had consented to sex with him, so whoever he decided to penetrate it would have been rape. He seems to have been cleared on the grounds that if he had walked back into his (non-consenting) girlfriend's room and penetrated her without further ado, that would not have been rape. It obviously would have been.

:( scared and Angry all at once.

I just wanted to add another voice saying how disgusted and furious I am in response to this case.

I feel helpless. I don't live in the UK but am still classed as UK resident and am a voter. Is there anything I can do?

Mumbybumby · 27/02/2011 13:10

I am absolutely speechless.
As others have said, he would have been committing rape regardless of which woman he had sex with as neither consented.
Absolutely unbelieveable and disgusting.

SGM posted a link to the Attorney General further up thread. Not sure if that will help, but emailing his office is a start. Here is the link again.

Other than that - writing to MP? My hometown's MP is pretty hopeless tbh, so not sure if I will bother.

I remember Crown Court too! Had forgotten all about it before this thread.

My mum used to be glued to it

He basically stood up in court and said he wanted to rape his girlfriend, but he raped someone else by accident, and he was cleared of rape - is that right?

Best comment on here. My thoughts exactly.

Why the random story at the end??

BokenGirl · 02/03/2011 11:19

The monster who beat, strangled and raped me walked free from court yesterday. The evidence was so strong against him, even down to evidence of my hair being pulled from the root found in his car.The system has failed me badly and let this man walk free to hurt another girl and to walk around the same town i live in.I hoped to try and rebuild my life in some sense once id got some justice, ive now not even got that to hold onto.I wont ever get over the horror of what i suffered that night and now im even further from moving on.What were the jury thinking, they were presented with a book of photos showing bruises, the marks from being strangled,i repeated so many times "please dont do this to me" should that have been enough? I just need some advice,is there nothing more i can do now,its so wrong,im the victim here, how have i been failed so badly?

How awful bokengirl, I'm sorry you've been failed so badly by the justice system, it's shocking that he was able to walk free from court, i don't understand how its allowed to happen.

BokenGirl · 02/03/2011 11:31

Bokengirl, I'm so sorry for what he did to you. It's painful even to read about your experience so I can't imagine what you must be going through. There will be lots of women on soon to give you practical and supportive advice

The police are just saying they are in shock by the outcome.I wanted his previous to be brought up but they wouldnt, hes an evil person, had the jury known about his previous they would never have let him walk free anyway. What he did to me that night came easy to him,i fougnt so hard that night,i begged and pleaded but he didnt care one bit,he wanted what he wanted and he didnt care what happened to me,i just dont know where to go from here, surely theres something i can do to try and get justice for myself and protect the next girl he sets his sights on!

The injustice in the OP is bad enough, but how the hell was your monster found innocent BG ? I thought the law had been changed and they could bring up previous convictions now.

Dittany is right, www.rapecrisis.org.uk/
are excellent.

so sorry to hear your story BrokenGirl. And very much hoping you are getting all the support you need. obv. Rape Crisis may be helpful. I think I'm speaking for everyone here to offer unconditional support to you through this horrible experience. Can we do anything to help you?

BrokenGirl11 · 02/03/2011 12:44

im currently in contact with a girl from rape crisis, shes coming tomorrow to my house as im not doing good with leaving it at the moment and now im not more so as he lives in the same town as me. This is just a living nightmare,i cant get answers, the only one im getting is that the case is now closed and i have to move on,i cant move on, i cant except that hes now free after what he did to me,i held on to that one word...guilty,for so many months,i feel angry at the police, they could have done more for me in court, from the word go when this all started they painted me a picture of just how evil he is,the police wanted to move me out the county for my protection after my windows were all put through one night when me and my baby girl were inside. He also offered me money through a 3rd party to drop the charges, none of this was used in court,no one would listen to me when i pleaded with them to bring up everything they had on him. My injurys alone should have been enough and the fact that i made myself clear that i was not consenting to it that night, the jury should be ashamed

aliceliddell · 02/03/2011 12:46
