Man cleared of rape because he was too drunk to realise which bed he was in.

Sorry DM but here.

This guy's girlfriend refused sex, he stumbled into another room "by accident" and started having sex with the woman in the bed there.

He was cleared of rape.

There is so much wrong with this that I don't know where to start. I imagine he's been cleared because he didn't intend (apparently) to commit a crime. But the fact is that neither woman had consented to sex with him, so whoever he decided to penetrate it would have been rape. He seems to have been cleared on the grounds that if he had walked back into his (non-consenting) girlfriend's room and penetrated her without further ado, that would not have been rape. It obviously would have been.

:( scared and Angry all at once.

thank you for all taking time out to reply back to me,i really appreciate it

BrokenGirl, I feel so so so outraged on your behalf. What that evil monster has done is beyond the pale, and I am seriously impressed by your strength and courageousness in taking it all the way to court.

I have written to the Attorney General, and if anyone else knows anything I can do to add my voice of protest I will do it. I live overseas, but would come back to the UK and protest on the streets if it would help.

Perhaps it's too soon, but have you considered telling your story (with names changed, for legal reasons as well as personal) to a reputable newspaper like The Guardian? Perhaps that could help add to a campaign to reform rape laws and the justice system?

of course the jury should never sleep straight in their beds after betraying you like that. you are doing really well at looking after yourself and your little girl through this. Is there anyone you could go and stay with to get a break from where you live? it might give you a bit of space to think what you want to do next.

The system is not set up to support you, sadly, BrokenGirl but there are people on here who believe you - lots of us are going to London to march and demand an end to male violence against women and children - I will be thinking of you."

How about ALL violence against women and children

just a thought...if the id of the rapist is known, is there any way of publicising that with no legal ramifications for the publicists?

HandDivedScallopsrgreat · 02/03/2011 13:56

BrokenGirl I really feel for you. I can't imagine how traumatic this is for you. The system has let you down completely. Please don't feel that this is any way your fault.

A number of us will going on the march this weekend and I'm sure our thoughts will be with you. Please take care of yourself.

I don't think this is the thread to bring up your issue with the MWR march joeking.

joeking · 02/03/2011 13:56

I'm agreeing with your cause, I just think if you want to attract maximum support to create maximum impact ( which after all is the object of the exercise isn't it?)then being inclusive is the way to go about it.

Coming across (even if you're not) as a hater of any section of society thank god will never be mainstream.

aliceliddell · 02/03/2011 13:57

but in the long term, we need a campaign to change the legal/judicial situation. any ideas?

joeking · 02/03/2011 13:59

err' it was mentioned on this thread HDS, and not by me, so why wouldn't anyone who wanted to comment on it ?

well, joeking, hating the section of society known as "women" certainly is mainstream. that's why at least 2 women a week are killed by men. and 1 in 4 are subject to domestic violence. and 1 in 5 to sexual violence. welcome to our world.

joeking · 02/03/2011 14:07

no no no no no, that is a piss poor effort.....I suggested "ALL violence against women and children", not just "all violence".

Alice, I think complete anonimity for alleged victim/perpetrator until a charge of guilty is found would be a great help as it would take a lot of pressure off the police and lead to more cases coming to court. Also previous charges should be taken into consideration before the jury reaches a verdict as offenders are often serial offenders and previous behaviour must be a considered factor.

I'm sorry but that is complete and utter bollocks

I agree with you Prolesworth, its a shame Englebert used it to raise her own cause instead of concentrating on the obvious fuck up the OP has endured thanks to our legal system.
