It would be difficult to get a conviction without evidence or witnesses . In a big trial near where I live there was evidence of injury and other people were in the house. But still no conviction.
I don't know how the writers will move forward.

Women can only be charged with assisting a man with rape. They cannot actually commit a rape. (Unless you think women have penises.)

I've just rewatched the end of the relevant episode.
Amy went into the bedroom, fell over. Aaron went in and helped her onto the bed. They kissed. He took her top off, she had a cami top underneath. They kissed a bit more. She said she felt sick and laid down. He was 'spooning' her and kissing her shoulder. She passed out. He kept kissing her shoulder/ back. She was still passed out. We saw her knickers land on the floor.

End of episode.
