Driving without MOT

CM1897 · 08/09/2023 16:17

I don’t drive (health reasons), so I’m not sure how bad this is.

My ex has started to drive without an MOT, would you send your child with him in the car? Could he be arrested?

he’s due to pick our three year old daughter tonight, I’ve asked him to get a bus to pick her up, but he refuses. I’m not sure whether to keep her with me or not.

Thanks

His insurance will 100% be invalid with an expired MOT

This is a myth. Often repeated.

It’s true
Check your policy
valid insurance if valid MOT in force

I know it's true but that makes absolutely no sense really? Surely the older the car is the more problems it will have.

I suspect that the thinking behind this was old cars tend to have been looked after. At the time old cars tended to rot and a car surviving after 25 years would probably have been looked after, someone's pride and joy.

iamwhatiam23 · 08/09/2023 19:45

@kimchiforever its absolutely not true! Depends on the insurance company!

I imagine there are some insurers that don’t mind you not having an MOT, but most won’t insure you without an MOT

Thank you op

More importantly though - how did it go?

Unlikely. I was hit recently and my car was written off, my MOT was three months out of date as I’d misread my certificate and thought it was due on 03/06/23, but it was 06/03/23. All they did was minus the average cost of an MOT from my payout, so £50.

Driving without insurance needs reporting to the police. My friend's son was killed by an uninsured driver. They tend to be careless, irresponsible people. A neighbour's husband was seriously disabled by an uninsured driver. No compensation due to no insurance.

Not the point of the thread but the motor insurers bureau pay compensation out to victims of uninsured drivers. If it happened fairly recently your neighbour should look into it.

@Simonjt what insurer?

They would have been required by law to notify the police

User16328715 · 09/09/2023 06:35

People aren't generally arrested for no MOT, the car is more likely to be seized if found be driven not to a garage for the MOT.

I would be more concerned about his general dangerous driving.

Hastings.

kimchiforever · 09/09/2023 06:55

And they notified the police as they are required to?

User16328715 · 09/09/2023 07:03

You can get reminders for MOT if you sign up on Gov.UK, they email you a month before its due.

Well oddly enough I don’t work in their call centre, so how would I have any idea of what they do?

No they are not!!! I had exactly the same happen to me! The insurance company don't give a shit! To be honest I don't think the police generally give a shit either! They have better things to do!

Oakbeam · 09/09/2023 08:40

As a minimum you will have insurance as required by the Road Traffic Act (i.e. 3rd party only). They will do this because Road Traffic Act states that it is an offence to refuse to indemnify somebody under an insurance policy due to matters relating to the condition of the vehicle.

Not giving a shot is not the same as what they are required by law to do

Which law?

kimchiforever · 09/09/2023 09:14

It is the law to have a valid MOT

if the insurer is aware that a customer has broken a law, they are obliged to inform police

User16328715 · 09/09/2023 09:15

They are much hotter on no tax than no mot as it fills the coffers.

kimchiforever · 09/09/2023 09:17

taxing a car without a valid mot is illegal

Throwing this into the mix , this car may well be old enough to be MOT exempt . One of mine is and has been for 27 years , still get it done every year though .

Not sure he'd be paying for it on finance if that was the case ...

Depending on the dates you could have no mot for ages before tax is due. My tax is in August which is five months after my mot in March
