Novack - so why are they reassessing people whose conditions are never going to improve then? I can see the point if you have a condition where you might get better, but if is permanent and incapacitating then it's a waste of time and money as well as cruel.

Novack, that's bollocks. I have been assessed as being fit for work by ATOS, against the clinical advice of my Neurologist, who heads up one of the best Neurology departments in the South.

So forgive me if I take the opinion that you are talking out of your arsehole when you say that genuine claimants have nothing to fear.

I have been without my ESA and DLA for over two years now. Stopping my DLA also stopped my Direct Payments from Adult Social care, which helped me to pay for a gardener as it is dangerous for me to use a lawn mower. I am now in danger of losing my tenancy as I can't afford to pay out of my Income Support.

On top of that, I was also taken off the OT waiting list for a wet room conversion. I had been on the list for 6 years, and was next in the list at the point I was taken off it due to no longer receiving DLA. I am only able to strip wash over a sink as I am not able to afford to fit a shower myself, and it is dangerous for me to have baths.

I also lost my Direct Payments that paid for me to hire a carer from an agency for the 24 hours after I had a seizure.

Being in receipt of DLA is the 'key' to accessing all of these services and help. None of which I receive any more.

The DWP lied to me when I asked for an appeal, and told me that I had been unsuccessful in my appeal by telephone. Turns out that I had been given a 'reconsideration' NOT an appeal. Which I didn't find out until AFTER it had been too long to ACTUALLY appeal.

So Novack, you can fuck the fuck off with your insistence that genuine claimants have nothing to fear from being reassessed, and when you get there, fuck off some more.

thekidsrule, I'm certainly not saying no one receiving IB/ESA/DLA etc should ever be reassessed.

I never complained about assessments until the ATOS ones came in. Because despite being horrible to undergo they appeared to be doing a fair, neutral, honest job of trying to assess you.

Now they're not - there's an aim to stop paying benefits, and the assessments are simply to meet that aim.

And when someone (as in originally linked article) is being assessed to see if their arms have grown back, it's clear there's something very wrong. Some people really can be given lifetime awards. Some, like myself, can fairly be reassessed every 2 years. Others should be on different periods.

I have no idea of your personal circumstances and that is between you and the managers who deal with your claims for benefits.

It is not uncommon for those who can no longer manage to keep their garden up to move to a more manageable property. Perhaps that is a viable option for you.

I told mine that I was sick of Irritable Duncan Syndrome, Grayling and the rest of those cunts inventing cruel and unusual ways to deprive people of their rightful benefits and encouraging hatred to deflect attention from their piss-poor ideas about what the fuck to do help people get jobs as opposed to holding on to their own.

So she said: 'Well, why don't you do something about it?'

Sadly, I couldn't argue with that so did the next best thing and volunteered at my local CAB which has shamefully been moved from down the road to three miles away.

I fill in forms and sometimes point out the law to nasty, stupid arseholes.

When I can't, I refer them to people who know the law better than i do.

It's very satisfying.

And if Direct Payments (which are there to cover additional costs of disabilities, like gardening) had their own criteria for assessment rather than being linked to DLA/ESA, I wouldn't be do bothered about being reassessed.

I have been medically retired TWICE in the 8.5 years since my diagnosis. I'm NOT fit for work, according to the OH depts of both a major architecture firm, and a major, green supermarket, and my Neurologist. Yet ATOS say I am...

ive also got apsolutly no objections to people being reassesed, but why do it with a condition that is a lifetime one?

and why on earth should it be done by a person with no medical qualifications?
why should it be done in a way that leaves people stuck on a floor unable to get up?
or classes a person as none compliant if they are unable to engage as a direct result of there disability?
or totally ignores a real docter or specialist or ot social worker?

its stuff like that, that i think is wrong.

And if the CAB hadn't been limited in who they could help, by funding cuts for legal Aid, then I might not be in this situation. Because often, those with genuine disabilities need the help of the CAB's trained advisors to help them fill in the forms, because, well, they're disabled and they need help with it!

Right now, there is a solicitor who specialises in ATOS appeals deciding whether to take my case on pro bono, because he feels that I have been mistreated by ATOS.

But obviously, Novack, in your cosy safe little world, I can't possibly be a genuine claimant because ATOS said so. Hmm

I feel astonished that you feel that a tick-box officer with no medical training was able to assess the severity of my Neurological disability and the effects that it has on my life better than my own Neurologist.

Of course, knowing that the next step in the treatment of my epilepsy is invasive brain surgery that may leave me even MORE disabled, in other ways, makes me even more fit for work, doesn't it?! HmmConfused

intresting thought but if a person stood in the street spouting bile implying disabled people who are elligable to recive the mobility componant of dla at the highest rate are theving scum akin to benefit cheats and the tax payer shouldnt have to fund them, they could be arrested for a public order offence and it would be concidered to be a hate crime.

ok nicholas, i have no idea how to reinstate but heres a lowdown if it helps

to those who didnt see it, i accused nicholas of calling me a troll i was especially cross about this because as far as i am concerned i made no personal attack, i also got a bit uppity because i thought he thought i was being disablist and hatefull, as some of you may know im registered disabled myself and 5 of my kids are also hence my Angry.

i do fully accept that i did say that a persons post made them sound like a twat and that i was sure in rl they wernt.

but in all fairness imo saying disabled people shouldnt get assistance via motability, and should be subject to humiliating tests by none medical personal despite the fact that no other group in the comunity is subject to this disgracefull behaviour is a personal attack on every disabled person
