Fair access portal secondary school in year

Hi some of you might remember my post before I was doing a appeal to get my daughter back to her original school after moving her (which ended up being a big mistake) I lost the appeal and that was enough for my daughter to completely lose it and I had no choice but to de-register her from the school , she has now been home schooled for 8 weeks , this is not what we wanted and my daughter is desperate to get back to her original school still, I reapplied 1st aug for her to stay on the waiting lisT again , I keep in contact with the admissions lady at my daughters original school where she wants to go back to , she told me to go the route of fair access protocol as she has been out of school for so long . Can anyone tell me about this and if this would be any good for my daughter , she should be starting year 9 in September this is such a important year , I just need her back to school ☹️

Are there any local schools with vacancies? If so, then presumably FAP wouldn't apply as your child could attend one of these. If not, then you could ask for FAP but may well not be given your preferred school, just one most able to cope with an additional child. Given you have already lost an appeal for your preferred school, I'm not sure this would be an obvious route. FAP isn't a way of circumventing the appeals process, it is for those situations where there are NO local places available.

@spanieleyes hi I have not applied for her to go to any other schools , I don’t know if you saw my last thread but she started at her original school in year 7 I moved her school in year 8 but it ended up being a big mistake , she wanted to go back to her old school and has been on the waiting list ever since ,there is no point in her starting yet another school because her heart is set on getting back to her old school , she has lost so much confidence since the school I de registered her from the children were not nice to her , she just wants to be back at the school which she was happy at and has many friends , starting yet another school will not work , I just hope there’s spaces after this summer holiday 😞

FAP is not for this type of situation. They place children who for example might be known to social services or police; asylum seekers new to the country; children at risk of exclusion due to poor behaviour etc.
If you appealed for a year 8 place, you can now appeal for a year 9 place, despite losing last time, a different panel may take a different view.
Make sure you have evidence to support your appeal, eg a GP letter or support from anyone else to prove that your daughter needs a place at the chosen school.

As @Raera says, it wouldn't be FAP under these circumstances. I'm afraid the only option you have is to appeal again.

Hi thank you for replying , it does say on the list those included who are out of school for 4 weeks or more ?
I don’t know anything about it tbh it was the admissions lady at the school who told me to try this route ,

In my LEA if a FAP panel refuse a place, the child is removed from the waiting list, so proceed with caution!
Have you asked the LEA admissions team for advice rather than just the school you want?

It is for those also out of education but only when there is no school within reasonable travelling distance with vacancies, it isn't a way of getting into a specific school without appealing.You COULD be lucky and, if there are no local vacancies, be assigned to your preferred school but there is no guarantee.

I literally just had a call from London Borough Redbridge education because I emailed Colin Stewart the head of education ,
im extremely upset now because the man on the phone was so rude and condescending, he literally just said there’s no spaces at the school and it’s your own fault she’s not still there, I asked him how he knew there are no spaces as the waiting list only opened on the 1st august , and I’ve reapplied first thing that morning , he said as of the week before there is no spaces , he was so rude and had no empathy to the point where I’ve lost it down the phone to him , honestly this is the worst situation I’ve ever been in I don’t know what to do or who to help me ,

The FAP is for pupils who have been out of education for 4 weeks or more where there are no places within a reasonable distance from home. You have been home schooling, so your daughter is not out of education. Even if she was, there is a place available within a reasonable distance from home. It just isn't a place you want. So, I'm afraid that your daughter does not qualify to be considered under the FAP.

Your only options are:

  • appeal
  • hope that a place comes up via the waiting list
  • continue home schooling
  • accept a place at any school within a reasonable distance from home
I know that you really want to get your daughter back to her original school, but the school is clearly full or you would have been offered a place previously, so a successful appeal or a place coming up via the waiting list are the only ways that is going to happen.

I never get my hopes up anymore ☹️I just keep trying every Avenue possible

There must have been huge issues with the school / your daughter for you to move her in the first place.
Have you any reason to believe she’d fare any better this time round even if by some miracle she got a place?

Honestly if all you had to do to get your child into a specific school was email the Director of Education everyone would do it, so no I dont think there is anything he can do or should do above and beyond the usual processes.

I think you need to consider what you will do in September if your daughter can't go to her chosen school.

No, he can't break the Law and make a school that doesn't have a place give it to you.

You need to apply to other schools and if there are no places, you'd then be eligible for FAP.

You made a mistake and now you cannot correct it. If there is no place at her old school then there is no place. The director of education or whoever called you cannot magic one up. Just go on the waiting list while you send her to the second one if they have a place. And if she has another problem then do not remove her, work with the school to settle it.

Hi she is on the waiting list I re-applied 1st august for the new school year I can’t see where she is on that list until 1st September now. I’m not asking for him to make a space I’m just wondering if there is anything he can do as I don’t know , he has asked for my number so I will just wait and see instead of asking here as it seems everyone here is experts on schooling 🙄

As others have said, if your appeal for her old school had failed, then all you can do is stay on the waiting list and continue to home educate.

Are you sure that there are no other local schools which might be an option?
