Financial Consent Order Processing Time

Consent order has been submitted via online portal. Anyone submitted theirs recently and can give an idea of current processing times? I know it depends which Court deal with it but would be good to get a idea…Thanks.

Bit of an update re complaints process, filed complaint yesterday 11.07.24 via HMCTS complaints portal & received a reply today informing me that my complaint would be looked at by the 28.07.24.
Not overly impressed when added to the 11 weeks 3 days I've already been waiting 🤦 but hope it's quicker .

From my experience they never replied at all but just expedited it in the background and next news, approved! Hang in there, it’ll make a difference.

Hiya Folks,

Just wanted to update you all, my brothers financial consent order was approved on 11th July.

However, his ex's solicitor is saying she wont action anything in the consent order until its "officially sealed".

He rang HMCTS yesterday and finally got through to someone after 3 hours on hold! The person said 'our system is showing the consent order is not approved, you need to ring your local court and tell them to email us' he emailed the local court yesterday and got an email back saying it can take up to 14 weeks for a response!

He also asked HMCTS about the final order which is applied for via post on 11th July and they just told him 'it takes up to 5 business days and we don't provided a printed copy so you will get an email'

So the story continues!

13 1/2 weeks since application posted by solicitor & today received this message from the courts .
I haven't got a clue what it means apart from more delays & expense .
After 5 years im on the verge of giving up .

Hi all. Sorry for the long post, please bear with me.
We heard back from conveyancing today so now waiting for the solicitor to draft the financial consent and clean break order and then send it off.
I am worried the judge will say that it is unfair so I am not sure what happens then? Any ideas?

So my payout should be 50k as my ex is keeping the marital house and I am renting. Children (12&16) are staying with me 50% of the time and other half with him. By accepting 50k, the ex would keep the marital home and pay me out 50k but he would then also get half my current pension (50k)
I brought a property into the relationship with me which is abroad and my parents live there rent free.

I agreed to a 10k payout instead of 50k but he can’t touch my pension or house abroad as we weren’t sure how it works with me having brought it into the marriage.
I also signed child benefit over to him already so he can claim UC to bump up his part time wages as I am working full time on a good wage.
We didn’t agree on any spousal support but £50/month for the child support.

i can’t figure out if the judge would see this as fair or not. 🤷‍♀️🤷‍♀️🤷‍♀️

any experience etc would be much appreciated

@Jena151 how long did it take to be approved once it was resubmitted/questions answered? In similar situation, was just asked to reconfirm that I am happy with my my order to go ahead, but now I am not sure how much longer to expect to wait. It has been over 2 months already to get to this point...

Oh no..I'm on week 3. I was told we'd hear back 2-4 weeks after submitting.

I had an initial meeting with my solicitor yesterday and she said it would take around 2 years to get the financial order sorted! I could cry. Me and stbexh are living in the same house and need to sell this to move on. Reading some of your posts above it's hopefully not going to be this long though! 🙏🏼

That can't be right- the court processing time isn't near two years! Maybe it may take this long for the two of you to agree how to split equity/pensions etc, but if he doesn't engage then it goes to court. The worst pensions to get CETVs for are Teachers ones I think- took me 8 months to get his through but once you've agreed everything the actual financial order should go through "relatively" quickly.

I am a teacher and luckily they took other documents rather than CETV for my teacher pension otherwise we would still be waiting. Teacher pension scheme an absolute joke.

Do you have the financial order ready to go?
I paid for an expensive solicitor as knew my STBEH would too and it didn’t pay off actually. She had pound signs on her eyes and dragged it out as long as she could so worth considering if your solicitor has your best interests at heart.

Teacher here too! Yes I've read some horror stories about Teacher's Pensions 😣
I've only just had an initial meeting with my solicitor but she comes recommended from others so hopefully she'll be worth her money. She's not cheap either! 😬🙈

Fishergirl It will be 2 yrs in July for me as it has gone to final order (March) and trust me or case is the most straight forward case of all. Also living in the same house.
It is better that the solicitor gives you the worst case scenario. Prepare yourself for an emotional battle. My adult children have wrapped their arms around me and suffering with me.
Hope yours gets sorted sooner.
