Financial Consent Order Processing Time

Jonathan70 · 09/02/2024 12:47

Consent order has been submitted via online portal. Anyone submitted theirs recently and can give an idea of current processing times? I know it depends which Court deal with it but would be good to get a idea…Thanks.

He probably haven't applied for the divorce online hence have to submit a form at each stage

Select2000 · 18/06/2024 16:34

to note, my sols asked me to apply online directly whilst they assisted with the financial order.

ah ok, not sure where the disparity is on that... maybe it's as he's doing his own financial order or something?

solicitors go down the HMCTS portal whereas non-sols can apply directly - have attached images!

https://www.gov.uk/divorce/file-for-divorce

He just tried this and it only lets him create a new divorce application...he thought he could enter the case reference and continue the existing divorce application but doesn't look like it. He said he'll just post the final order.

His solicitor originally applied for his divorce online

He is very eager for this to be all over, he's been waiting 15 months now!

Jena151 · 18/06/2024 19:21

If there is more than 12 months after the first decree/ decree nisi, it needs out of time application to get decree absolute/ final order. My ex’s solicitor has submitted required documents on 29 th May but still waiting

lutestring34 · 19/06/2024 21:36

just to update I speak to my brother daily and still no update and no reply from his soon to be ex wife's solicitor...

Mcca501 · 22/06/2024 07:46

Latest update. .. still no word. Nearly 8 weeks now.

Spoke to my solicitor to find out it isn't Birmingham but in fact chesterfield court and with it being smaller there are less judges and therfore a longer wait.
So the conditional order was Birmingham but now consent order chesterfield.

Interesting thanks for the update, I spoke to my brother this morning he had an update from his ex wife's solicitor who said
"The consent order remains with the judge waiting for approval"

No further update, he is unsure which court the consent order has been sent to, he assumes its either Nottingham or Birmingham.

It's so bad your at 8 weeks :( I don't know how my brother will cope if he has to wait another 4 weeks!

LittleBm · 22/06/2024 10:55

Mine is still waiting too, submitted over 6 weeks ago. I spoke to my solicitor and she has another case which takes a while too. She said the court must be very busy.

8 weeks I was told was supposed to be the max! It’s really frustrating not having a certain timescale to work to or aim towards!

im almost trying to forget about it and hoping an email will just pop in saying its done at this point, easier said than done though!

Mcca501 · 25/06/2024 17:20

8 weeks today and not a peep... so frustrating

Nimbus1999 · 25/06/2024 19:14

I’ve been waiting for 6 weeks and nothing. Our house is sold so the split depends on them approving the consent order. Gah!

Same. My solicitor is also away so I can’t even get an update from her as to if mines with a judge!

im hoping it gets sorted before kids holidays as I reckon that will delay things too…

Stuff like that is so bad, they should at least give a maximum timescale so you can plan at least! I’m 6 weeks 5 days. Not that I’m counting 🤣

Re the two weeks between financial consent order and final order. My divorce was a joint online application. The financial consent order was submitted by my ex’s solicitor on their portal. My ex therefore found out the consent order was approved before me (because I had to wait for an email via solicitors). She then pressed go on the final order and I got notification that she had done this. I was then given two wks to also press go for final order, before she could finalise things herself. I did it immediately and it was confirmed to us both hours later. But that may be where the two wk confusion comes about. Had I not done it, she would have had to wait two wks before giving me notice that she would finalise things herself.

Just wanted to add some dates for people who were anxiously waiting like me in case it helps.

Submission: 20 May
Assigned to judge: 29 May
Approved by judge: 22 June

So just shy of five weeks. No changes requested and the order was heavily weighted in my favour (70/30) due to an inheritance my ex-husband thankfully didn't go after.

It looks like the judge works for the courts in Northampton.

Mcca501 · 26/06/2024 19:35

@Albinosquirrel888 that's very quick. I think it's disgusting how we are penalised for where we live. 8 weeks and still nothing for me

lutestring34 · 27/06/2024 17:30

Hi Folks,

Just to update you I spoke to my brother today and still no update...4 weeks now and counting...have a good weekend , lets hope for some good news next week!

Select2000 · 27/06/2024 21:23

Hey,

I've had some bad news. My solicitor checked my application and apparently due to a 'technical error', my application reverted to the stage before submitted.

This means I've lost 7 weeks for nothing. The advice from the courts is that you can 'try' and resubmit, if it reverts again, try a new application.

It's not good enough - apparently very occasionally even when with a judge it can also revert back in stage as the IT system is poor.

I'm complaining with HMCTS but wanted to flag in case it's worth chasing your own cases.

My solicitor said that the case is referred to judges all over, so there is no actual local court restrictions, and current timescale is 4-6 weeks.

Wow! I am so sorry to hear this! this is just unacceptable! Surely as its a technical error it should be fast tracked when resubmitted!

Select2000 · 01/07/2024 10:27

yeah you would hope so, however by all accounts there isn't anything I can do and there are no staff to help! Will see if I get a response to my complaint but I highly doubt it..

LittleBm · 01/07/2024 16:04

@Select2000 I'm so sorry to hear that. It must be extremely frustrating especially when the waiting time is so long. I hope it gets sorted soon.

I thought I give an update for everyone who's still waiting. My consent order has been passed to the judge on 16th May and approved on the 29th June, no question asked 50/50 split.

Mcca501 · 01/07/2024 17:50

@LittleBm congrats. Send some luck my way please. It's 9 weeks tomorrow and still nothing 😫

LittleBm · 01/07/2024 19:31

@Select2000 @Mcca501 thank you both. It's a massive relief tbh. I hope both of yours gets approved soon 🤞 good luck 😊
