Hi,

do you get notified as soon as the conditional order is applied for? Or only when approved? The online tracker doesnt have a tick against the conditional order, but I am confused why the Ex hasnt applied for it. Do you get an email reminder?

thanks

This is a new house I am buying in my name and he is staying in the matrimonial home. I need the funds from him before I can exchange and don’t want to pay higher stamp on 2 houses. And now the vendors want to put back on the market as it’s taken so long so far. It’s so stressful but I’m more fortunate than a lot of people on here

NoMackerel · 05/08/2023 09:34

I applied for a Conditional Order on 4 June. It was read out in a courtroom somewhere on 6 July but the certificate was granted on 23 June.
On 18 August i can applied for the final order which I’m told Will take 2 or 3 days.
The Consent Order, which is probably what you need to have stamped by the court in order to fulfill the financial obligations / agreement, should be done / stamped before completing the Final Order application. That, I’m told takes about 6 wells at the moment. I know that because we have filled it all in with the solicitor (D81 included with the solicitor order) and i am waiting for the last version to sign so it can be submitted.
At the suggested timeframe my 18 August date for applying for the Final Order is going to be more like 15 September.
Mainly delayed because my soon-to-be-ex has been “too busy to fill in the paperwork “

Danidutch · 05/08/2023 13:22

I applied on 26th July officially, still waiting for my update. I am going through with a clean break order so I am hoping my final order won't be as complicated.

nably · 09/08/2023 12:57

@Danidutch ill be interested to hear when you hear that its been 'sealed' by the court.

@NoMackerel I waited weeks for my STBEH's solicitors to send back the D81 and conditional order eventually told him to get his solicitors to pull their finger out was very frustrating when its a relatively simple clean break.

Floodles0307 · 27/08/2023 09:01

if anyone can give me an idea I’d be grateful. I applied for a divorce in my sole name which my ex has agreed to. The 20 weeks is up on the 21st October which is when I can apply for the conditional order. We have agreed finances, and the solicitors are drawing up the consent order, we are going for a clean break. When do you think I can realistically be divorced? This 20 weeks feels like forever!!

NoMackerel · 08/09/2023 18:46

Do you have a house you’re selling?
if so, wait until the Consent Order has been stamped by the court before you apply for the Final Order.
From conditional order application to final order is going to be about 5-6 weeks at the moment.
Final order takes hours to days

NoMackerel · 08/09/2023 18:57

@nably Well I went away for 6 weeks to work, came home for 2 weeks and then away again, still no action. My STBEW took so long to do anything with it, then her solicitor was constantly on holidays. I've signed my part and now waiting for her solicitor to send my Ex the actual completed form/D81 so she can sign it off. Then finally it can be sent to the court by her solicitor if they bother to get round to it.
She's trying to buy a place to move into once ours is completed but I've told her I'm not signing any exchange forms until the court stamp the Consent Order so I expect she'll end up losing her purchase, her own fault.
It's her last element of control in a 32 year controlling relationship I guess.

Floodles0307 · 10/09/2023 06:43

Thanks for this information. Yes we have a house we are selling, what an awful time to sell though. I think the consent order will all be done long before we manage to sell. I just want to be divorced!!

nably · 11/09/2023 21:04

@NoMackerel definitely have to wait until its all sealed by the court. I have received the sealed order 4 weeks after it was submitted to the portal. Its all a waiting game and very frustrating but anything can happen until the judge seals the order.

LMR77 · 14/09/2023 12:03

Hi everyone.
So I am a sole applicant, no kids, or financials to sort. I applied for my conditional order on 19/08/23. They said i will be emailed by 16th Sep which is 2 days away. I've not had anything so far, but have seen other people have had their confirmation / court date provided within a week or two. Is anyone else in this position? Is there a backlog currently thats been mentioned at all?

thranduil · 14/09/2023 15:25

Hi @LMR77, Not sure whether any delays have been reported, but just to let you know, I'm currently in a similar position on a similar timescale - applied on the 22nd August, with a response date by 19th September: No confirmation or court date provided yet.

LMR77 · 14/09/2023 15:29

Thanks... I keep checking my email every half hour... just want this done now...

thranduil · 19/09/2023 13:06

Don't suppose you heard anything by your deadline date, @LMR77? It's mine today, and still no word.

LMR77 · 19/09/2023 13:40

Hi @thranduil I'd had no email on Saturday, so I called them yesterday. They told me the team were a few days behind, so I should get my email with court date by the end of Wednesday.

thranduil · 19/09/2023 13:53

Great, thanks @LMR77 - hopefully we'll hear this week. My thoughts of it being actioned in 48-72hrs after submitting seem rather naive now!

Yeah, same here! I think those people were rather fortunate! I don't have a particular urgency, just want all ties to be cut with the person asap. Noone wants to stay tied to someone who mentally abused them for any longer than necessary :-)

NoMackerel · 20/09/2023 14:34

@nably that’s very useful to know. Today the solicitor submitted the consent order to the court for the clean break.
Hopefully 4 weeks time, fingers crossed. Just waiting to hear if the house is sold too. No wonder people go grey waiting 😂

LMR77 · 21/09/2023 16:36

Hi, so I had my conditional order accepted today. Court read out is 2 weeks today (5th October) after which I can apply for final order on 17th November... :-)

NoMackerel · 04/10/2023 21:40

Congratulations! 😄

NoMackerel · 04/10/2023 21:44

The Application to the court (online) for our consent order was made 20 September. It was read out and approved by the judge 28 September so only took a week.
Just applied for the final order now. We’ll see if that’s the 1-2 days they say.

Bareagan · 05/10/2023 14:20

I have applied for Conditional order on 30th September does anyone know currently how long it is taking for them to be heard in court.

laineyp1 · 10/10/2023 14:39

My daughter applied 6 Sep and was told would be emailed by 4 Oct. Received nothing and phoned and was told they are taking 6-8 weeks not 4 at the moment due to a backlog

Omaa · 24/10/2023 14:15

Hi just need some clarifications
i am the sole applicant, no kids, no finance together, no properties together
just want my peace.
Am currently waiting for conditional order
i want to know if I must apply for financial order.
NB: I already ticked yes during the application.

Danidutch · 24/10/2023 20:22

Is it wrong to get divorced then get married again the following week? Lol

Floodles0307 · 12/12/2023 19:45

So my conditional order should have been pronounced in court today but I haven’t had an email with a certificate yet. Can the solicitor send in the financial consent order, or do I need to wait for the conditional order certificate?
