I need to rant!

Got a letter from the council to say that my neighbours are building an extension, went around to ask for a full copy of the plans, as where we live (hill) will cause issues to our house. They said that they did not have any and that they did not know planning was even sought, bullshit!

I went online and yep there plans show that they are trying to build on our bloody land. Fuck me they must think I am stupid.

This is normal when objections have been raised if the original plans would have been granted by delegated powers.
The planning officers will now have to do a full set of reports. All objections will be shared as part of this.

As discussed extensively on this thread, the planning committee are not concerned about ownership of the land.

Planning don’t care who owns the land. You can get planning permission on land you don’t own. It doesn’t mean you can actually build there.
You get planning, then you go buy the land and then you build. Planning isn’t refused because of ownership.

If they get planning permission, it doesn’t actually matter. They still can’t build without permission of the landowner so OP would just kick them off and remove anything placed on her land while taking civil action for trespass.

CFC must have had a telling off from the plannings as they have changed their description.

Alas they have not submitted new plans, measurements or amended any plans.

Back I go to make another comment saying that the plans are wrong and are incorrect.

Local councillor has become very interested as they can’t even make the drawings out.

Biggest spoiler they still want to build on my garden.

Sorry I can’t remember as this has been going on a while. Have you sent them a recorded/solicitors letter just telling them they have no access to your land or permission to build on it.
I think they must be unhinged to keep pushing it. They really can’t accept it can’t happen.

sure 9mm I probably would say anything but 9cm I’d be kicking up a fuss…. 9 inches is almost a bloody foot and definitely skin of my nose…. No one in their right mind would stand for 9 inches of land being stolen !

Did you write to planning and dispute their plans? Surely it’s a pretty simple NO to them being granted planning permission??

I agree with all the people saying what a cheek the neighbour has assuming they can help themselves to 9 inches of the op’s land and cutting down a tree on their land.

Another update.

CCFC neighbour have spoken to my husband and said they are not going to build the nice wall in our garden as we have put an objection in, and we are being petty and just nasty and not allowing them to build the terrace they want. Planning has not even been determined yet.

There has been no new plans/drawings submitted, so god only knows what will be built.

What they do not seem to grasp is if they are granted planning and do not build exactly what has been granted they will be forced to demolish what they have built.

I will sit back and see what CCFN do next.
All this could have been avoided if they actually spoke to us, instead of being stupid twats that thought that they could have got away with being sneaky, they are lower than a snakes belly.

It's such a frustrating process waiting for the planning handle to crank. But fighting the plans on two sides with blatant boundary indiscretions at least means you have a comrade in the battle. Anyone can technically get planning permission to build on someone else's land but you are correct that they can't actually enact it without your permission. How dumb to not realise that when they made an enemy of you.
