I need to rant!

Got a letter from the council to say that my neighbours are building an extension, went around to ask for a full copy of the plans, as where we live (hill) will cause issues to our house. They said that they did not have any and that they did not know planning was even sought, bullshit!

I went online and yep there plans show that they are trying to build on our bloody land. Fuck me they must think I am stupid.

It's such a frustrating process waiting for the planning handle to crank. But fighting the plans on two sides with blatant boundary indiscretions at least means you have a comrade in the battle. Anyone can technically get planning permission to build on someone else's land but you are correct that they can't actually enact it without your permission. How dumb to not realise that when they made an enemy of you.

Planning cranking their gears is correct.

If CCFC, came to speak to us and said we will resubmit the plans not build in your garden but up to the boundary. We would be very happy to remove our objections. They would still have to get a party wall agreement.

My neighbours tried to build on some of my land. They came round one day to tell me I had to move my fence back and cut my trees as they needed extra space to build their extension! I got straight onto planning with a copy of my deeds/plans and it appeared the cheeky neighbours hadn’t even sought planning permission for the extension they’d already started! They were paid a visit by the planning department and had to stop building.

In England you can apply for planning permission on land you don’t own, but you have to fill in a certificate saying who the landowner is, and that you have tried to get in contact with them.

I do not believe anything that they say and will never believe anything.

I have also gone onto the planning portal to see anything.

Yep they still want to remove the tree that we have in the garden, they never showed it on the drawing but it is clearly there.

The wall runs right where the tree is, I think that they thought that if no one objected planning would never come round and approve it.

How big us the tree? Frankly I'd be a bit worried that they would come in when I wasn't there and cut it down! They sound unhinged.

@Feckedupbundle is right. You can apply to do anything on land you don't own. The planners will only consider the application against planning law, they're not interested in ownership. That would be down to the two parties involved.

I'd be getting a solicitor's letter to them pdq to get them to back the fuck off and send a copy to the planning department. They're being so unbelievably cheeky, you have to fight fire with fire. They sound like the kind of wankers who will wait until you're on holiday and then you'll come back to the approved plans made real.

Another update!

UCCFC (thanks for that @HelplessSoul ) did go round to their neighbours on the other side and chat with them.

UCCFC wanted to use their neighbours garden to bring in all their building materials, and builders to access the build by coming across their garden.

Neighbours on the other side said no, they were talking about plans and exactly what would be happening and dragged it out for weeks, UCCFC told neighbours that it was passed the determination date so they could not comment, UCCFC smirked while saying this and said that this was what they wanted.

Neighbour on the other side, has now served UCCFC a legal notice as their boundary is now in dispute. That no access will be given and UCCFC have never had a right of way over their property.

Neighbour came and knocked on our door and thanked us for spotting the mistakes and UCCFC having to put in a new description so they can now comment and put in an objection. Neighbour has also commented about trees they would need to cut down in neighbours garden.

UCCFC now have pissed off both their neighbours.

I am honestly speechless, about all of this and their sense of entitlement.

We will have to see if the planning department approve their plans or if UCCFC are going to amend their plans. My husband joked that we will probably get an invoice for the cost of any extra plans they will have to have drawn up.

Beware of them simply ignoring this once they start work. I sent that sort of letter to my neighbour but their builders still ignored it in all sorts of annoying ways, even though it stopped them putting up the scaffolding they'd wanted & going all over our property. It limited the damage but didn't prevent it.

Do remember though that even if they do get given planning permission (and this is so bat shit I would be really surprised) they legally cannot build on land they do not own.

I would suggest you encourage other people to object to the plans because in our borough you need 5 or 10 (I can't remember at the minute) objections to get it in front of the planning committee for a decision, rather than delegated to the planning officer. Then you get the chance to speak at planning committee.
