The cafe stole my cinnamon swirls?!?!?

I went into a cafe with a takeaway and ordered a coffee and two cinnamon swirls to go.

I paid and they put the cinnamon swirls in a box behind the counter whilst I waited for the coffee.

Then a waitress appeared and said the cinnamon swirls were already on order for a table and took them out of the box and back on display for the table order.

Then they gave me a refund for the cinnamon swirls.

At the time I was disappointed but it just sort of all happened.

AIBU to think that actually, once I’d paid, that they were mine and that they had no right to take them back?

Yes that's weird, I'd have asked for a refund for the coffee too for the incontinence to be honest. I know it sounds petty and first world problems but if they'd been boxed up for you and you'd paid its shitty service to take them back as they can't manage their stock before taking peoples money.

Maybe the other customers paid for them before you did?
Very odd and unprofessional either way, I’d probably swerve the place for a while. Hope you found some nice pastries elsewhere.

Did you ask what happened? Why did you give my swirls away? They might have explained that the table had already paid- but they should have said.

They gave them to the customer who paid for them first. Disappointing but reasonable I think.

It is weird, only because they could just have easily have put the box on the counter by you and you could have then picked it up/put it in your bag rather than out of reach - at that point I can't imagine they'd have asked you to give them back- and if they had that you would have agreed! Or that the other people would have appreciated handed back pastries that had been in someone's handbag!

If the other people had ordered but hadn't paid (as is usual if you're getting sit down service, to pay once you've consumed the food) but you had ordered AND paid then you take priority and from that point they were yours!

Plus which you getting them would involve less handling of the food (usually preferable) and less of a faff (as they wouldn't have to sort you a refund).

If it makes you feel better, this morning I ordered a croissant with a coffee and only realised when I got home that I had no pastry with me. At least you got your refund! I paid the idiot tax.

I love a cinnamon swirl, and would have been mortified . I suppose if the other customer had also already paid for them, they had first dibs. BTW, have you seen these cinnamon Palmier biscuits from M&S? I am scoffing them as we speak.

That happened to me in a local coffeeshop. I ordered a coffee and paid for a pastry which was put on a plate which they said they'd bring over when the coffee was ready. Before they could do that one of the other staff sold the pastry to someone else, so when they brought the coffee over I asked for a refund and left.

You had paid so they were yours (the basics of a contract - offer, acceptance, consideration) They might have been on order for a table but unless that table had already paid for them your purchase overrode that - they were no longer available for sale. Nerdy lawyer response but I would have been pissed off too!

These are SO easy to make.

Unravel a packet of puff pastry.
Spread a mixture of equal part cinnamon/castor surgar across the entire pastry.
Roll the pastry back into a roll and slice in fingers.
Bake for 10 minutes at 180 in the airfryer.
Couldn't be easier.
Drizzle with a little icing sugar if you like.

These are a huge hit here.

I had a similar thing happen - I asked for a pain au raisin (hate asking for them as I feel I have to say it 'in French' and sound pretentious)
Then as the barista was making the coffee somebody else asked for one and got the one left.
They had none left so I had to get something else (I know - first world problem)
