The cafe stole my cinnamon swirls?!?!?

I went into a cafe with a takeaway and ordered a coffee and two cinnamon swirls to go.

I paid and they put the cinnamon swirls in a box behind the counter whilst I waited for the coffee.

Then a waitress appeared and said the cinnamon swirls were already on order for a table and took them out of the box and back on display for the table order.

Then they gave me a refund for the cinnamon swirls.

At the time I was disappointed but it just sort of all happened.

AIBU to think that actually, once I’d paid, that they were mine and that they had no right to take them back?

Invitation to treat was the pastries for display- you offered to buy them, they accepted when they took your cash. Concluded contract, of which they were in breach when they took the pastries back…

but you got your money back, and there are no damages for disappointment in not eating pastry, so sadly, whilst you’re technically right, I think that’s where it ends..

I see @Flatandhappy beat me to the nerdy lawyer response…😂
