Who is in the wrong?

I've named changed for this. Writing here as I need to take the emotion out if the situation.

Car A waiting at a junction to turn right, protruding over the give way lines.
Car B driving on main road, slows to see car A at the junction. Recognises that if car A had no where to go if they were to let them out due to traffic on the other side of the road so continues on driving around car A. Car A proceeds to turn right and hits the side of car B.

I'm not too sure I've explained it clearly but can clarify if you need it.

Car A.

maddening · 18/01/2021 15:57

A is in the wrong

2typesofjungle · 18/01/2021 15:58

Car A

Bargebill19 · 18/01/2021 15:58

I guess the question is who is in the wrong?
From what you’ve said - car A

Petitmum · 18/01/2021 15:58

Car A

Astroscoach · 18/01/2021 16:00

@Bargebill19 yes, I'm asking who is in the wrong. Thank you.

Thank you for your responses.

Its one of my pet hates when people pull out when the other side of the road isn't clear.

Car A is at fault (assuming B was just driving along the road and hadn't pulled out of a side road after A started the maneuver)

Astroscoach · 18/01/2021 16:03

@HunterHearstHelmsley car B was driving along the main road.

Car A

MaskingForIt · 18/01/2021 16:05

Car A is in the wrong. I assume you were Car B. Car A shouldn’t have turned just because Car B slowed down.

justaweeone · 18/01/2021 16:05

Car A

TerribleZebra · 18/01/2021 16:06

Car A - whoever is on the main road has right of way

Calmandmeasured1 · 18/01/2021 16:07

Car A is at fault. The give way markings mean they need to give way to traffic on the main road they wish to join.

BriocheForBreakfast · 18/01/2021 16:08

Car A

bloodywhitecat · 18/01/2021 16:08

Car A, they are crossing a Give Way marking on the road so they shouldn't proceed until they are certain the road they are entering is clear.

Astroscoach · 18/01/2021 16:11

@MaskingForIt yes I am car B. I slowed because he was over the line and I used that time to assess the situation. If I was to stop to let car A out then he would gave caused a build up of traffic until the other side was clear or someone let him out. Car A is adamant that someone on the other side flashed him to go.

PistolKnight · 18/01/2021 16:12

Car A if it happened as per the description

RunnerDuck2020 · 18/01/2021 16:12

Car A definitely in the wrong - whoever is on the main road would have right of way. Hope you’re ok.

MythsandSparkles · 18/01/2021 16:12

Car A

Car B could have been flashing his lights with the driver performing semaphore to signal to Car A to pull out and it would still be Car As fault if they drove into Car B - they are crossing a line of traffic and the onus is on them to ensure their right of way is clear - not rely on other drivers instructions so the perceived slowing down of Car B is irrelevant.

Justforphoto · 18/01/2021 16:15

someone could have been flashing but it's irrelevant in this situation as you didn't stop. Friend had a similar situation a few years ago and he ended up with his insurance paying for the damage to all 3 cars that ended up being hit.

Winterwoollies · 18/01/2021 16:16

Whether someone flashed them or not is entirely irrelevant. Car A is in the wrong.

IthinkIm · 18/01/2021 16:17

I need a diagram.

AryaStarkWolf · 18/01/2021 16:18

Yeah agree with others, they can't use someone flashing them as a right to pull out on the main road

Imiss2019 · 18/01/2021 16:18

Irrelevant if another car was flashing him out and off topic but this is exactly why I don’t flash kids across the road either.

Bargebill19 · 18/01/2021 16:19

“Someone on the other side flashed” , that could have been someone driving over a pothole/drain....still doesn’t make it ok for car A to proceed without checking both lanes.
