Apparently, for 'Obstruction of justice' to stick would depend on exactly what Comey and the FBI were doing at the time.

Asking now (CNN) why Comey did nothing else apart from write his memo. The Trumpsters can use that question as a form of attack.

They are now talking again about Comey's sense of his own integrity; it might lead him to believe that he could still work with the White House and build some bridges, especially since the alleged conversation involved a request rather than an order from Trump.
