Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

This is absolutely outrageous and sounds illegal - doesn’t redundancy require a process not just a P45 in the post! Is the niece starting in the same position as you held? If so I really don’t see how your position can be redundant.

Let us know what ACAS say.

I've recently gone through something a little similar (and won!)
You absolutely have a case for unfair dismissal. Follow ACAS procedure to start with but please don't be put off by any response they give - In my experience, ACAS were just a formality my ex employer thought they were bigger than. It took me 2 years of stress, tears and worry but my
Outcome was better than I could ever have expected.
PM me if you want advice but get onto a no win no fee solicitor immediately and get them ready for action 👍🏼

more information will be sent in the post? Well unless that information contains a big fat cheque of redundancy pay and a groveling apology for going about this totally the wrong way i'd be kicking off. In fact, scratch that even if i got all that i'd still be kicking off because this is appalling. See if your friend can get the nieces job title and description - because if its the same or close to yours they are fooooooked.

Wow, the fact that people can still do this is crazy, glad you’ve had good advice. Could you ask the colleague to screenshot the message/email she was given about your supposedly handing in your notice as that would be gold in a case?

Yes your role can be made redundant, if they can cover it with existing staff.

However they cannot just randomly terminate your employment. You have a very strong case here, and they have broken thr law.

I imagine you would have a cast iron case for unfair dismissal. Get legal advice, take them to the cleaners and never go back. Your boss sounds like a complete tosser.

You can defintely claim unfair dismissal, and you will be due a hefty pay out too as compensation. Don’t drop this.

Tbh it sounds already like they’ve got wind of your displeasure and are now back tracking to try and cover their arses. Hence now mention of redundancy. Don’t let anyone, even friends know what you are doing legally. Just talk to Acas, take the very good advice here, and get a solicitor.

This is so wrong on so many counts.
Good God. Am incredulous.
Anyway, Citizens Advice should be able to help. Check their website. They have online live help and a phone number. (In my local area in a case like this there are lawyers who would act on your behalf for free once it starts to get tricky but it varies area to area).
If it is ANY comfort, your employers have done this all so very, very, very, very, badly as soon as your employers get any legal advice what's so ever the lawyer will tell them to settle asap.They do not have a leg to stand on. Absolute case study how not to do something.
