Randomly sent my P45?

I’m so confused, I work for a car dealership and have been off on maternity due to go back on 11th October, today I’ve randomly received my end of employment p45 in the post? Yet no one from my work have told me I’ve been sacked or lost my job? There are no redundancies either. I went to message my boss on our work group chat to see I’ve been removed. I’ve never had any warnings or disciplinaries nor am I on a probation period as I’ve been there 8 and a half years. Can they legally do this?

You will definitely have grounds to claim against them if this is what they have done.

Definitely get legal advice...no, they absolutely can't legally do that. You'll be entitled to a big payout, esp after 8.5 years service

They definitely cannot just send you your P45 so hopefully it is a case it’s been sent in error.

You could call ACAS or citizens advice to ask where you stand as they will know the rules.

Call Maternity Action, they're an organisation who advises on working rights etc in these circumstances

You need to ring ACAS and maternity action as soon as possible. I think you can take them to the cleaners as they appear to have unlawfully ended your employment. Fucking hell! I’d squeeze every bloody penny out of them. Is it a national chain?

Get this thread moved to employment so you can get proper advice and take them to the cleaners, this is rediculous behaviour and in breach of lots of legislation!

That is very odd, the WhatsApp thing suggests it's not a mistake but what a strange thing to do.

Even the most clueless employ must know you don't send P45s out of treble.

If this is a certain dealership group that begins with an S my sister works for them and has just been made redundant and they have been appalling. Get yourself a solicitor.

Perhaps they thought you wouldn’t know as when I left my job I didn’t get a P45, something to do with it being online as they are phasing out paper P45s. I have registered for the online tax account and I think that is why I didn’t get one as it said I left my job on there. Good job you got a paper one.

I once got sent my P45 in the post when a colleague with the same surname resigned. Everyone in HR was totally bemused until I remembered this colleague. I also got phone calls for her for years after she had left.

Ring ACAS tomorrow and start the ball rolling.

Sometimes I'm truly flabbergasted at what employers think they can get away with.

If it's a mistake they owe you a big apology. If it isn't, they're going to owe you a wheelbarrow filled with money. Because, no, they can't do this.

It never fails to amaze me how crass some small business managers can be.

I worked for a teaching agency and they did this annually. Not because they were sacking me but because the work was sporadic, and if I found a full time position elsewhere then I would need the info on it. It did seem a little bit daft but maybe your employers have a similar reason?

Also agree with others that you would be entitled to a big payout. Make sure you get it in writing as well that they have effectively randomly fired you but not told you. It was done completely illegally. You cannot just ignore someone who has worked for 8 years you have to make them redundant and offer a redundancy package.

Especially if on maternity.

Only deal with them in writing from now on. Get a solicitor. You'll get a fairly decent payout from this, it's pretty indefensible on their part.
