Five nurses working at Darlington Memorial Hospital filed a legal case against their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses objected to sharing the women’s changing facilities with a male colleague, Rose, who identifies as female. The hearing was held between 20th October and 11th November and was live tweeted by Tribunal Tweets who have comprehensive information regarding this case on their substack, including archives of the twitter threads, lists of people involved and press releases.

At the time this thread was started, the judgment had not yet been published on the Courts website but was widely reported in the media that the NHS was found to have discriminated against the nurses, but the claims against Rose were not upheld.

Agreed.

This also causes endless problems with incompatible IT systems meaning patients notes aren't always visible across different hospitals and NHS services which can be extremely dangerous.

This goes right back to the 80s and the creation of individual NHS Trusts under Maggie Thatcher.

It is a disgrace that the law is being ignored on single sex spaces but in some ways it is the least of NHS problems.

I am a retired nurse and thank christ I don't have to work in the chaos anymore.

The amount of money that would be saved if all policy writing were centralised. And the added efficiency. And improved communication. And increased certainty...

Plus, crucially, you could employ actual clued up experts in the law and regs to write them. Rather than an army of under qualified dummies to copy and paste unlawful dribble.

Too sensible for the NHS, I guess.

I’ve been talking with the DH about the impending October budget and wondering what will be the next stealth tax. I understand that a functioning state needs money.

However, every day I drive by the behemoth of a beast known as HS2 and marvel at the complete waste of taxpayer money. How much waste and exploitation of funds that is entrenched in our construction industry. That Healey is scrabbling for defence budget increases and meanwhile over £100b is being spent to save 15 minutes on a train to London.

Likewise, I also believe there’s a lot of waste in the NHS. Certainly on the salaries of the likes of Ms Bumba. Reading this about individual trusts creating their own policies confirms this.

So much inefficiency. By bat crazy people who refuse to believe in biology or that women deserve dignity and privacy. What is wrong with people?

Indeed! Unconscionable lying bastards that they are. I'd say it's unbelievable, but it's not, is it?

Like MrsOverton says, I really don't think trust can be restored. In the NHS, the government or the Labour Party. But more deeply than that, in democracy itself. Or the human race in general. There's plenty of nihilism all around us and who can be surprised, frankly.

On a more pedestrian note, DC is thinking of going into a career that requires NHS involvement, and I'm seriously considering putting her off.

Tbh, I think the issues with the NHS are bigger than their ignoring of the law in this area.
They've been harming mothers and babies for years through inadequate maternity care with no consequences.
The Thirwall Inquiry that reported last week was critical of the repeated lack of safeguarding for the most vulnerable newborns.
That's just 2 from a depressing list

I'm not sure how we can ever restore confidence when all this is led / enabled by senior staff in the NHS who never get any consequences for their actions.

It’s about time somebody tackled Yvette Cooper about this stuff. She must surely oversee NHS England and hospitals (both of who are busy preparing to write big cheques to women).

BREAKING: Health minister Karin Smyth has told the Darlington nurses there is no plan for new NHS rules on single-sex spaces, despite the government previously promising action and institutions repeatedly saying they are 'waiting for guidance' following the Supreme Court ruling 18 months ago.

Bethany Hutchison and Annice Grundy met the minister in Leeds following the nurses’ landmark employment tribunal victory, supported by the Christian Legal Centre.

The nurses warned that, without clear national rules, NHS trusts remain free to impose policies that undermine the privacy, dignity and safety of female staff.

Bethany said: “The government has had long enough. The law is clear. Women should not have to go to court simply to secure a safe place to change.”

The Darlington nurses are calling for urgent, legally compliant NHS guidance protecting single-sex spaces.

Ah, yes, forgot about all the other policies! I wonder if they could just use the policies they had in place 15 years ago? I suppose some of those might be outdated now, though

Some things used not to need to be said at all, like 'using single-sex services for the opposite sex is not allowed' or 'patients who request a same-sex HCP should not be treated by an opposite-sex HCP in disguise'.

How about tearing up the 'trans' guidelines and replacing them with a) don't bully trans people, and b) if staff or patients refuse to use services for their own sex, try to provide a gender-neutral alternative if at all possible'?

What did I miss out?

That trans people shouldn't bully people who won't tell them they're brave, fearless and definitely female?

It seems like such an inefficient way of doing things. A crazy amount of duplication of effort.

The really crazy thing is that all 200 Trusts are individually writing their own (virtually identical) policies not just on Single Sex Spaces but in thousands of other policies on everything from Car Parks to Bullying to Antibiotic choice etc etc The big dirty secret about the National Health Service is that it isn't National at all but Balkanised into 200 different organisations all reinventing the wheel on a daily basis.

This is such nonsense. So much money could be saved by centralising this.

Where “reinventing the wheel” often means “cutting and pasting from the policies of the trust nearest us, because of course they must have bothered to get legal advice - which we are too lazy to do -and didn’t just c&p from somewhere else themselves.”
