”BREAKING: 1st Detransitioner to Take a Medical-Malpractice Lawsuit to Trial Wins $2 Million Judgement

Fox Varian sued her Westchester, NY, area psychologist and plastic surgeon for the gender-transition mastectomy she got at 16.

I was the only reporter to attend the entire 3-week, historic trial. Subscribe to my Substack to receive an alert about the feature article I have coming out next week in a major publication out about the trial: benryan.substack.com. I cover pediatric gender medicine as a specialty on my Substack.

Sorry to just give just a teaser for now about the case! But I wanted to get the word out about the verdict promptly, the slower pace of feature-article publishing notwithstanding.

The entire case file was put under seal when the trial started (although I obtained all those documents before they was sealed), and all the transcripts from the trial are also under seal. The riveting trial was sparsely attended and there was only one other reporter at the trial; and he only attended for part of it and, as I observed, took few notes. So my own hundreds of pages of notes from the trial will likely remain the only way for the public to learn about the all finer details of what transpired, possibly ever (or until an appeal, should that happen).

In addition to my article coming out in the media outlet soon, I intend to write a lot about what I observed and learned on my Substack over the coming weeks. Stay tuned…”

Wow! Another post in Ben Ryan's thread:

"I have identified 28 detransitioner lawsuits filed to date. Varian v. Einhorn was the first to go to trial and the first to win a judgment, making history. If anyone knows of any additional cases that are not on my spreadsheet below or sees any errors, please DM me."

Some of them might be settled out of court by now so we might not get to know the outcomes.

This not just good news for Fox Varian but for all the others on that list and this must surely be a watershed moment?!

There can't be too many people called Fox Varian, so maybe she is this actress? In one of the films she is playing a character with a male name.

Well even if journalists aren’t paying attention the insurance companies will be. I don’t think it will be long before butchering children stops being something Americans can claim on their insurance. That still leaves self-funded people wide open but it will safeguard a lot. Well done Fox V

I wonder how these cases will deal with the rather short statutory limitation periods in US states, often 2 or 3 years.

The laws really vary all over in different jurisdictions around the world. In some places, the time frame on the statute of limitations only commences once you recognise an injury from the malpractice. This makes sense in many cases, some injuries may not come to light for years after the event.

So for gender medicine, there is lots of scope for this as people only realise the extent of how they’ve been injured years later.

I also think a lot of doctors will get away with it due to statute of limitations too 😡

surely can’t apply to medical malpractice where the damage may not become apparent until years later (whether physical or psychological)?

IANAL, but again I think it varies from place to place even for children. Some places say 21, so 3 years after you’ve turned 18 to make a claim.

One thing someone like Ben Ryan should do is advertise all this for each US state and embed that idea into trans/detrans circles so anyone who might be thinking about it gets a move on if they’re running out of time.

Wondering how this might impact on the ghoulish Sidhbh Gallagher, who has no insurance ISTR.
