US Detransitioner wins medical malpractice lawsuit and receives $2 million

From US reporter Benjamin Ryan

”BREAKING: 1st Detransitioner to Take a Medical-Malpractice Lawsuit to Trial Wins $2 Million Judgement

Fox Varian sued her Westchester, NY, area psychologist and plastic surgeon for the gender-transition mastectomy she got at 16.

I was the only reporter to attend the entire 3-week, historic trial. Subscribe to my Substack to receive an alert about the feature article I have coming out next week in a major publication out about the trial: benryan.substack.com. I cover pediatric gender medicine as a specialty on my Substack.

Sorry to just give just a teaser for now about the case! But I wanted to get the word out about the verdict promptly, the slower pace of feature-article publishing notwithstanding.

The entire case file was put under seal when the trial started (although I obtained all those documents before they was sealed), and all the transcripts from the trial are also under seal. The riveting trial was sparsely attended and there was only one other reporter at the trial; and he only attended for part of it and, as I observed, took few notes. So my own hundreds of pages of notes from the trial will likely remain the only way for the public to learn about the all finer details of what transpired, possibly ever (or until an appeal, should that happen).

In addition to my article coming out in the media outlet soon, I intend to write a lot about what I observed and learned on my Substack over the coming weeks. Stay tuned…”

May this be the start of an avalanche.

Good. And that is by no means an excessive payout. The mental and physical medically inflicted damage is highly likely to end in some adults left unable to earn a living. It is a wicked thing to do to a child for political reasons and then blame it on the child 'wanting it'.

And this would be a strong case for overturning and ending the limitations on claims in American law.

Lovelyview · 31/01/2026 10:40

After the Hampstead Ponds setback I was feeling a bit gloomy about how long it is taking to get rid of this nonsense but this news has cheered me right up. As others have said, hitting them in the pocket is going to bring it all to a screeching halt. There's also the investigation into fake billing going on in the US at the moment which I hope will lead to equally eye-watering damage to US health care providers.

Yes indeed. Paging all NHS insurers.

The NHS is insured by public taxes.

Part of the problem is that legal fees and payout are not financial lines on Trust budgets

Fife contract obligation to provide a strip show case :
https://www.google.com/amp/s/www.bbc.com/news/articles/c75rxpnqx9yo.amp

Fife tracks sick days costs but had no way to calculate let alone track the cost of forcing front line female staff to change in front of a male.

Their budget line will be £25k.

The Board were not even (or so claimed) tracking the direct costs involved. So staff time and board time were not included in the pricing.

The same will happen if the NHS is sued each case will incur legal fees and court time to establish a £££

The States insurance calculation may be subjected to political pressure and costs spread across all rather than be weighted against providers

Shows how far the trans lobby has reached when a court case is treated as if it's of national security and everything had to be sealed/hushed up.

Yes, WHY is it under such tight wraps?

Wondering how this might impact on the ghoulish Sidhbh Gallagher, who has no insurance ISTR.

Never heard of her, googled her, had a little trivial detour into noting that she either mis-spells or mis-pronounces her own first name, as 'Sidhbh' is pronounced 'Sheev' in Irish, not 'Sive' as she claims.🙄

There is a fawning article about her in the Irish Times dated 2018.

We Want Investigation Into Irish Trans Surgery Doctor, Say Her Patients

I look forward to reading an article in the Irish Times dated 2026 about her getting sued.

RedToothBrush · 31/01/2026 11:04

Yes everyone who warned transitioning kids was a Very Bad Idea Certain To End In Expensive Lawsuits Which Will Win, will eventually end up not only being able to say "I fucking told you so" but will also pay for the privilege of doing so!

Aren't we lucky?!

whatwouldafeministdo · 31/01/2026 11:04

Let's hope the little scam of not having insurance results in personal liability and, ideally, criminal prosecution.

There's a picture of her posing with Simon Harris which will be acutely embarrassing for him when the time comes 😄

Dear god.

The point of an exclusive is it's exclusive. It doesn't stop the exclusive being accurate.

They could of course, get the fuck of AI and stop being dumb idiots and seek out the source of the original court ruling.

But that would be too much like hard work and thinking for yourself.

But 's' before a slender vowel is 'sh' in Irish, as in Síle, so it would be 'shee-uhv'.
Sadhbh has a broad vowel after the 's' so it remains an 's' sound Sa-uhv which said quickly becomes Sive

Sorry everybody for the obsessive derail, I know it's a trivial detail but..😐

MarieDeGournay · 31/01/2026 11:27

Tallisker · 31/01/2026 11:13

Like scythe? But with a ‘v’?

Yes that would be correct for Sadhbh, But not Sidhbh.
[the 'h' in Irish is not an actual letter, it is used to indicated that the preceding consonant is softened, or in the case of the 'd', not pronounced at all. The 'b' is softened to a 'v' sound.
See? It all makes perfect sense😄

'Scythe' would be a useful word for Sadhbhs - Saoirse Ronan amusingly says her name is pronounced' Saoirse, rhymes with inertia'😁

Sorry I'm doing it again😬 I'll stop this derail right now. Promise.

Well she wouldn't be the first I've come across to spell an Irish name in an odd way. God knows what the Americans call her 😱

This is great news.

The biggest win will be when insurers start pulling coverage from Doctors carrying out these surgeries.

Yes this is how it will stop. Not because of the harm it does to vulnerable adults and children but because of money .

To draw an analogy with another public health harm – smoking in enclosed public spaces like pubs, clubs and restaurants. For decades Public health campaigners tried to get this stopped without any success.

But as soon as there were successful legal claims from ( non smoking) workers who had developed asthma or lung cancer from exposure to smoke at work - insurers either withdrew cover or increased premiums. This happened even though most claims were settled out of court, so it didn’t set a legal precedent.

Powerful lobby groups can influence politicians and even the courts . But they have no influence over insurers .
