"Darlington Nurses" vs County Durham and Darlington NHS Trust Tribunal Thread

Five nurses working at Darlington Memorial Hospital have filed a legal case suing their employer, an NHS trust, for sexual harassment and sex discrimination. The nurses object to sharing the women’s changing facilities with a male colleague, “Rose”, who:

  • identifies as female
  • has not undergone any physical or hormonal transition and has full male genitalia
  • has cited inclusivity policies
  • is backed by the trust’s HR department
  • has been granted access to a single-sex changing room for women.

The NHS trust’s HR department dismissed the nurses’ concerns, stating they should “broaden their mindset” and “be educated”. More details can be found at Sex Matters

The hearing is due to start on October 20th and is scheduled to last 3 weeks. To view the hearing online email: [email protected] [[email protected]] requesting remote access to the case of 2501192/2024 Hutchinson and others Vs County Durham and Darlington NHS Trust, starting 20th October. In earlier hearings reported at http://archive.today/nh5v9, the claimants were supported by the Christian Legal Centre and represented by Pavel Stroilov (solicitor) and Bruno Quentaville (barrister). The respondents were represented by Simon Cheetham KC. We do not know yet if the same representation will be in place for the October hearing

I won't link to the crowdfunder, but in the early hours of this morning Graham Linehan set one up to pay for a private detective to compile a dossier on these men. As you say @GargoylesofBeelzebub many of us could name them.

This is going to turn up the heat on the run-up to the hearing. It's awful that the nurses have to deal with this extra stress, which I guess was the goal of the complainants.

But those four "concerned members of the public" don't realise that vexatious actions like this only increase the public sympathy for the nurses and damage the cause of trans rights.

It adds to the dramatic picture of the angelic nurses speaking plain common sense being targeted by a few women-hating obsessive weirdos, while a cash-strapped NHS bleeds money for the sake of a minority ideology. With every action TRAs are peaking more and more people. Keep up the good work lads!

Just because they've been reported it doesnt mean the NMC need to do anything about it. They could politely tell the vexatious TRAs to bog off - they won't of course because NMC think the nurses are being unreasonable. That's the thing with all of these reports; they could tell these men to fuck off but they never do

Hmm. I'm more hopeful on that front. They did refuse to represent Sandie Peggie. But she's now suing them, which shoud make them have a little think. And since the SC judgement their policy does seem to have done a reverse ferret.

The NMC are the professional regulatory body for nurses and midwives (and completely captured) but it is the union, the RCN (royal College of Nursing) that Sandie Peggie is suing.

All these TLAs do meld into one after a while!

Surely if they end up in trouble with the NMC then that will increase any damages in their claim against their Trust? It’s the Trust’s illegal practices that caused them to whistleblow

They're already at 5k. I'm definitely going to follow for updates.

The NMC website has free speech guidance.

It acknowledges specifically that Gender Critical beliefs are protected.

They should be fine. They've already got lawyers.

I agree with those posters about the adequacy of these changing rooms. I did mention this in my first post under the (admittedly vague) "issues".

The case though doesn't seem to be about improving these female only changing facilities.

I'll bite.

30 women were relegated to a space just about the size for half a dozen.

That space has no benches, lockers, toilets, sinks, or showers.

Rose has been given a 30 person space with benches, a vast choice lockers, sinks and showers, all to himself.

Your move.

No matter how captured these organisations are - their in-house lawyers or whatever central legal services they have - post SC confirmation that men remain men (despite any mental illness of AGP or gender dysphoria or just plain old perversion) and so should be advising their clients to settle.

And those legally responsible - should know that having received such legal advice they would be in breach of their legal and fiduciary duties by ignoring it.

They don't have to break them. All they have to do is a 'thorough investigation' that puts people under pressure for years and bingo, there they are, 'the process is the punishment.' This technique is widely used across public services...

Well, I still think there will be plenty to look forward to. At the directions hearing in the spring, R's counsel was reckoning cross examination of 'key witness Rose' would take at least a couple of days.

So he will be attending court. I don't know if Iain Masterton will be able to attend - if not I expect there will be press photogs about? I'd imagine pics could be in high demand.
