Secondary School mixed sex changing rooms complaint: Update from school (again)

Hello everyone - Have just received a further update from my daughters (14) secondary school (Brighton) regarding my complaint - which is at stage 2 - go to governors complaint, and my further email to the school asking them to comply with the EHRC interim guidance.

I'll copy both responses below, redacted.

I would very, very much appreciate specific feedback to include in my responses to the school, it's been people here (and elsewhere) who have helped me put together really powerful letters that have clearly rattled the school.

However - there is still a male in the female changing spaces at this school. Therefore it is mixed sex.

NC as I had previous with Local Authority about a range of issues re Safeguarding, Funding decisions, transparency.

Unfortunately too many senior LA employees are completely signed up to this agenda. They will back the Head and when/if you ever get a response re your FOI requests I would not be surprised if the Head’s legal advice did not come directly from the LA Legal Department.

For those not familiar with how Brighton really works it has a extremely powerful informal network of powerful LGBT+++++ players that influence local policy, funding guidance and decisions , recruitment into key posts.

If you look at any of the threads which involve “trans” issues, women’s rights, safeguarding, Etc and dig into the details you will see the same people blocking access or crying “transphobia “ crop up again and again.

eg Women only Rape Counselling Service - Friends Centre - case on going.

Let Women Speak Brighton- who can forget Baby Bully

There are many other examples that I have witnessed first hand of women being literally thrown under the bus ( unfortunately in some cases by other women but this would be too outing.

I would not hold out much hope from the Brighton and Hove Police. Again see who sits on what Steering Groups and inter agency panels!

I would suggest your only chance of getting anywhere is pursuing this through legal channels.

I just double checked again with my daughter who is next to me eating pizza and yes, trans identified males are still in her changing rooms.

So how does your daughter and her classmates feel about this? Have any of them refused to get changed while there are boys present?

@TangenitalContrivencesfocus all efforts into discussing options with the solicitor at this point; they are clearly breaking the law and that should be relatively straightforward (??) - sorting the mixed sex issues out legally in the school is definitely a solid start to bringing the tower down LA wide

I need to emphasise that Labour are too ideological to set out guidelines stipulating single sex provision. They’re relying on the courts. Because of the situations laid out by Kemp

its highly unlikely that guidance coming from the DfE is going to be firm enough on this. A JR ruling would impact country wide if this solicitor agrees it’s a good route forward.

I would suggest trying a personal letter directly to Akua Reindorf as well as to the EHRC in general (I did recently have a reply within hours from the EHRC which was a cut and paste knee jerk email and needed to reply again saying no, read the email, they're obviously batting back a tidal wave of dross), and also to Baroness Nicholson in the HoL. Naomi Cunningham may also be interested in a general way. And Sex Matters are also likely to be interested.

Decades ago I was a school business manager and in that capacity used to attend Governor meetings. I can assure you that if there were ever a hint that we were failing in our care and not adequately safeguarding the pupils, there would have been the most enormous, screeching u-turn in whichever policy was at fault!

I simply can't believe that the Headteacher at your DDs' school is digging his heels in like this.

Do you know if boys are still accessing the girls' changing rooms (and vice versa)? The only way I can make sense of his position is if the trans children have been told to use unisex facilities (so there is no ongoing safeguarding risk) but he doesn't want to change the school's actual policy until he's had all the guidance from EHRC and the LA.

You know it is entirely possible this is happening - I can imagine that the political fall out of the most captured school in the most captured town to be quite epic.

However, as far as I can find out, changing rooms are still mixed sex and boys are being told to change with girls still

No (not that I know of) but they are afraid of being cancelled at school

And, all the parents and teachers encourage it, who has the guts at 13 / 14 to go against that?

Like @Kemptownboysaid the only route is going to be legal one. You are dealing with capture in an unimaginable scale. No letter to or from anyone is going to make any difference. They are acting illegally and need to be subject to a judicial review. It's the only way to affect change

The safeguarding lead certainly knows about it

The clerk to the governors certainly does

I cannot imagine the rest of them do not, but I have done my best to email them and keep them informed!

Agreed that this is potentially a massive case. Dr Upton's insistence on changing with his women colleagues exposed the extreme level of capture in the NHS to an appalled public. The actions of adults in schools coercing girls to undress alongside teenage boys (and of course sharing toilets and on school trips, sleeping accommodation) perfectly highlights how anti safeguarding all this is.

To see presumably professional and DBS checked adults insisting that girls undressing have no right to boundaries from males is very revealing. And presumably, in that school any male teacher claiming to be a woman must by definition be allowed to watch the girls undress.

Every responsible knows that teenagers can be massively embarrassed by their bodies. It's a particularly cruel and humiliating act to insist on mixed sex undressing.

focus on what can be worked on with lawyer now. There’s a golden opportunity here but it must be done correctly

It would be interesting to see what happened if you reported that your DD is uncomfortable and unhappy but too afraid to say anything and what legal challenge she could have on her behalf.

A few people saying letter-writing is pointless. OP, I think you're doing the right thing in creating the paper trail that will very likely end up in court as evidence. It will be damning.

Can JKR’s women’s fighting fund help fund court application for injunction against school breaking the law? Not a lawyer but think injunction is remedy to stop an illegal act.

There was a post on here about Scottish courts ruling saying single sex loos in schools essential. Must be parallels as it’s the same law in this respect I’d think.

This is such a safeguarding disaster. Thank you OP for doing this. You have the evidence now that the school WILL NOT safeguard girls. If you go the legal route @TangenitalContrivences I will donate repeatedly until you have the money you need and this will be my only case to donate to. Please get good legal representation. This is urgent, adults failure to safeguard girls seems to be baked in and I wonder how many abuses are going on unseen. Girls cannot speak up in this atmosphere. It's appalling.

All any boy who wishes to watch a girl undress or expose himself to her has to do is say he's trans! And the adults in charge and responsible for safeguarding will enforce his abuse and willingly break the law, it's almost unbelievable.

Single sex spaces protect boys too.

Surely this madness will be looked back in the same way we now ask how it was allowed to make small children clean chimneys, or smoke in restaurants.
