NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #15

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although once it was in to the second week it was looking like this would not happen. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

However, as a result of problems with the livestreaming, apparently, as a result of a very large number of observers, remote public access to the hearing was suspended on Tuesday 11 February. It was suggested that it might be reinstated at some point but don't count on it.

Interesting - looking back at the calendar 25th Dec was a monday. 26th a tuesday - both would be bank holidays - assume like all other places closed. So discussion and email on Morning of 27th. It's not like you'd forget that you made a call and then emailed to confirm is it? More likely DU was on the phone as 9am ... shame they can't ask for phone records

They were closed on December 27th...

There was a discussion about whether KS could appear and juggling witnesses. NC got assertive and said that this needed sorting out asap or they would consider naming her as R3! JR got organising sharpish - so I think KS remains a witness only (for now)

And also if the next ET is July that is a long time where DU and KS will be in contact via work and it would be reasonable to expect discussion of the case to take place?

I'm amazed that there is still talk of further documents still to be disclosed.

What on earth do the two - or now three - respondents think they are doing?

And if KS is now added as a third respondent, is there a liklihood that they will have to dislcose emails etc too?

I didn't catch all of this (in hospital, no wifi, well limited), how did the BMA conversations come about, did DU go into work and say conversed with the BMA, and is there any possibility that this never happened but has been used to barrel down on getting what DU wants? Is there any evidence presented so far that BMA contact did definitely happen.

What I can't bear about this whole debacle is the utter waste of NHS funds.

He is so self obsessed and sure that he's a trailblazer and that he's the victim of bigots that he doesn't give a shit.

That alone makes him insidious. I have a good friend who works as an A&E consultant, she's tearing her hair out most of the time dealing with the demands of the job. Yet he calls himself caring.

I understand this is the rule, but it just seems so unrealistic to me. Is she, for example, never to go on Twitter in case somehow a Tribunal Tweets post comes onto her timeline? Is she not supposed to read the papers in case she comes across a report of other witnesses' testimony?

Alternatively, and slightly more... shall we say, maternal? humane? or just..non-criminal??🤔 you could teach them to play 'Dr Beth's Buzzword Bingo' between now and July, get them those huge dabby markers [washable, naturellement] and offer some ridiculously desirable prize, like ice-cream for dinner for a week, to whoever has the most buzzwords by close of play.

Exactly.

And surely anyone not a witness within the work environment who has caught wind of this means that that it could easily be workplace chatter.
