Non-binary customers win compensation for being asked if they are male or female

Financial services firms have been forced to pay hundreds of pounds in compensation to non-binary customers over “discriminatory” application forms.

MoneySuperMarket (MSM), the comparison website, and Transunion, a credit union, were hit with separate complaints because their application forms did not include options for non-binary customers in their gender section.

Both cases were escalated to the Financial Ombudsman Service (FOS) which awarded the complainants compensation for “distress and disappointment” incurred from the forms.

MSM was ordered to pay £200 to unnamed non-binary customer Mx B who was asked if they were male or female.

The company’s website did acknowledge the omission in an explanatory note and asked non-binary customers to refer to their sex at birth when asking for quotes, the complaint read.

Who the fuck has got time to be bothered about this sort of shit. Offended and distressed before they even start filling a form out ffs. I don't want to sound like a heartless cunt but who really cares what anyone else identifies as and if it's that difficult to tick a box asking if you are male or female then I'm not sure they should be on their own filling forms out.

Am i reading this correctly? If the form had asked them about their sex nothing would have happened but because it asked gender instead of sex they gòt hammered?

By the way when did forms become prudish and stopped using the word sex? I remember it being normal to use that (as a child) and the word gender was non existent.

It's a good point. Can we now sue anyone who asks for 'gender' and not 'sex' based on hurt feelings?

Are insurance companies relying on 'gender' then as a risk assessment measure? I thought men had more expensive accidents etc. Are they still covered if they 'felt female' at time of application?

Lloyds TSB ask for 'gender'. I find this most upsetting.

What I find equally annoying is why the bank needs to know. Same with why Debenhams (or whoever) needs to know if I am male, female, a Ms/Miss/Mrs.

On reading that, my main thought is that we need to consider pushing for the removal of any concessions anywhere in law for “gender reassignment” or “transgender identity” as they are now being misused.

”Gender identity” is not a protected characteristic under the EA and so called “non-binary” people should have to prove they are undergoing some kind of “gender reassignment” to qualify for protection under the act.

So we are now in a position where I think both the GRA, protection on the grounds of “gender reassignment” under the EA and especially “transgender identity” in the hate crime laws need to all go.

Failing that, hopefully someone will bring a court case against the deludedness of the FOS, who think “non-binary”is in any way protected under the EA.

We may as well!

This sounds like a grift. Beginning to wish I had declared myself enbie and put a claim in now. Easy money!
