Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

I am finalising witness statement this week, hoping to receive disclosure from the other side soon and we are working with Prof Phoenix as an expert witness.

Court starts on 16 March so I could do with a final push for the crowdfunder. Grateful if you could share the CrowdJustice link on your social media platforms please. I can't link it here (MN rules) but you can find it by searching for Faye Russell-Caldicott.

Speaking of which, can you guess who the pseudonym is "dedicated" to? 😂

Yes, I agree. I am thinking of starting the thread ahead of time, perhaps Saturday or Sunday so that we can promote the crowd funding needed with regular intervals for reminders during the breaks.

I will have school drop offs and pick ups to do so I'm keen to get ahead of the curve so that nothing is being missed out, and so we can show Faye our love and support ahead of the commencement so she knows we have got her back.

If @FayeRC is happy for me to post the link to the thread here once it's created so we can get some interest for the MN algorithm growing, we might be able to increase the likelihood of further donations.

So have they agreed now, at the last moment, that it was indirect discrimination on terms of sex and disability but not that they harassed you? This is extraordinary. Does it mean that toilets are back to being male and female (with exception of unisex and accessible)? This is huge. This could be the case that changes all future non-domestic toilet and changing room provision for many different places - schools too.

Presumably their defence is ‘you were right but we didn’t know you were right and we didn’t listen, and weren’t prepared to listen to you even though it was causing distress it wasn’t our fault. Our insistence that you were wrong was not wrong and wasn’t harassing. And even though we had multiple toilets suitable for your needs we took them away due to one person’s wants (not needs) overiding everyone else’s needs. But also your religious needs don’t count.’

Thank you for your persistence on this. It takes so much courage and determination.

i dont see how they can admit discrimination on sex and hold out on religion, unless they are saying that adds nothing extra because all women should not have to change in front of men. Maybe the defence will be along the lines of everyone was doing it, the law wasnt clear enough. We'll soon find out - unless they concede at the door of the court.

I have got school drop off to do tomorrow, as well as a very poorly DDog who will likely be being PTS tomorrow so there will be chunks during the day where I am not able to paste from TT, however, where absolutely possible I will be pasting from TT and it will be a welcome distraction.

Can I kindly ask that if anybody else is available to also paste in my periods of absence that you stick your hands up. I'll try and keep them as brief as possible and I'll let you know when they will be.

I look forward to seeing how much we can support further on the crowd justice page, and I'm certain we can make a sizeable dent in it during the tribunal, especially if we can get into trending.
