Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

Dear supporters,

next step in this process is to gather all the evidence, go through it and organise it, and exchange with the other side. We'll then look for gaps in what they have provided to us and will request further evidence if we feel something is missing.
I have a ton of material related to this case, spanning over nearly three years, as the issues at work started in Autumn 2022. Since I remain employed by the Respondent, there is accumulating material, too. My legal team will need to keep refreshing the case as we progress.

I'm now campaigning for the legal costs related to evidence prep. I've got an excellent solicitor and barrister and they are invaluable. If I didn't get the legal work covered, I'd probably continue on my own, but no one wants one of the first key cases in England to be a DIY job!

My supporters have been fantastic and you have been so lovely with your supportive messages, thank you. Many of you have donated more than once but I don't wish this to be a burden on a few individuals - instead I'd like to spread the word more effectively. I need more visibility. To help with this stage, could you kindly share the website link to my crowdfunder on various social media platforms this week please?

The employer is currently waiting for EHRC guidance. Their Trans Staff Policy is labelled 'under review' but practically continues to be in force.

I will keep you all updated on how we progress. All donations go directly to my legal team's client account.

@657904I It can be really costly and you need to think about the times when urgent work is needed, have you got funds then, not just the main bulks of work? The JKR fund requires a case is on-going.

I paid for ET1 and ET3 myself before the crowdfunder was set up. Even during the crowdfunder, I’ve kept the case going with smaller urgent payments, like Schedule of Loss, out of my own pocket. My own spending has been over £5k which I'll never get back. Legal costs cannot be claimed as damages in employment tribunals.

Crowdfunding (at 18k now) mainly supported two preliminary hearings, one cancelled, amending grounds of claim, disability impact statement and additional request for information which were all big chunks of work. The approaching exchange of evidence and subsequent reviewing it will be a big piece of work which I cannot pay myself, so I'm campaigning the hell out of this.

There is the option of self-representing. There are some very good books on how to do it, inc by naomi cunningham.

I haven't got an exact quote yet for the costs related to the next phase as the costs will partially depend on how much material we'll end up having (i.e. how large the case will be) so I'm not sure how much short we are. I'm currently undertaking the onerous task of thinking back nearly three years when this started in 2022 and hoping that I haven't forgotten an email or anything.

Also following the Fife case with interest and enjoying the roasted bbq smell lingering around after Naomi's cross.

Faye, I hope you get an uptick in donations, because 'it was decided' that as a gesture of appreciation to the valiant MNer who has been organising the 40-something threads that we've filled up with commentary on the Sandie Peggie tribunal, that we'd donate to your Crowdjustice page. We've done this kind of thing before - we donated to Sex Matters - of which Naomi Cunningham is Chair, and we donated to the charity that the Peggie family asked for donations to in memory of Sandie's father RIP.

Really dont understand how these organisations get away with wasting taxpayers money like this. I know NHS England is being abolished but why isnt Wes making it clear that anyone involved in defending this will be out of a job?

As a country girl, I think September is the time that the soil is tilled and new seeds are planted. The rain we've been having really helps the seeds to grow. And the sun too, of course.
