Handy to have if you are ever in the position of being either denied the right to female only space/service/safe & fair competition in sport or being told by anyone that even asking for this is evidence of any sort of "prejudice".

Taken from Joan McAlpine's twitter posts.

I remember that. It makes me absolutely furious, as it means that a woman has to be prepared to inform total fucking strangers that she doesn’t want to share because she was abused. If she doesn’t volunteer that distressing information, them she has to put up and shut up. Why the fuck should his rights over rule hers.

This is the problem with the case-by-case approach (which doesn't even seem to apply to NHS, since patients are segregated by gender identity). Women have to disclose highly personal information or risk being labelled a bigot by objecting without explanation. It's fundamentally discriminatory against women.

The letter from Rosa Freedman and others is very reassuring and helpful to be able to refer to. I want to be watertight should I ever need to refer to this, so this is the one query I had about it:

Where it says:
It is established in case law that the comparator for a transgender person claiming discrimination in relation to gender re-assignment is not the sex which they are seeking transition to but that which they are seeking transition from.

Can anyone point to which cases these are? Sorry to ask, IANAL so I want to be able to rebut if there is challenge.

Hi chattylion

Look at R (Green) v Secretary of State for Justice [2013] EWHC 3491.

Fantastic letter-so in trying not to be discriminatory against Transsexuals protected under Gender Reassignment (which is the right thing to do) organisations have bent over backwards to the extent that they have toppled over onto women-eroding our rights under Sex as a protected characteristic (which is not the right thing to do).
This would all have slipped under the radar-had they/GRA consultations not wanted to extend protections afforded to a tiny amount of Transsexuals to potentially every man who "feels" like a woman, on any given day -with no need to even kid on "living as a woman" (whatever that means Confused). Why do all Feminists not see that this will extend it to all men, which will wipe out "women" as a protected class/caste? Asking for a friend (women)...
