Letter from prominent lawyers highlighting what women's legal rights are under the EA2010

Handy to have if you are ever in the position of being either denied the right to female only space/service/safe & fair competition in sport or being told by anyone that even asking for this is evidence of any sort of "prejudice".

Taken from Joan McAlpine's twitter posts.

That's really helpful. There are a number of threads with questions that could be assisted by this.

Spokk · 30/03/2019 14:00

And that is exactly what I read, as a non-legal person, when I checked the Equality Act. I don’t know why so many people are pretending otherwise.

Spokk · 30/03/2019 14:00

As in, I do know, but I try to retain my sanity by not thinking into it too much.

WinnieHug · 30/03/2019 14:03

This is a great letter, hopefully it will give women the confidence to speak up if they are being told they have to accept male bodies in their their safe spaces, LEGALLY YOU DON'T! You have the legal right to say no.

Show it to schools who are insisting your daughters share facilities and sports events with trans girls. The law says girls have the right to ask for male bodies to be excluded in those circumstances.

In fact, it's time we started challenging these schools, swimming pools, girl guide Assoc. etc through the courts.

RedDogsBeg · 30/03/2019 14:05

I'd like to copy the contents of the letter and just keep repeating it ad naseum.

SusanSmithFWS · 30/03/2019 14:06

This letter was written in response to the misrepresentations in the TIE letter earlier this month. It was sent to the papers (Herald & National) who printed that letter and ran stories off the back of it. We believe it is in the public interest to correct the false narrative. Unfortunately, despite several approaches, the papers failed to print it.

Thanks. Have saved this for if (I mean when) I am given cause to use this.

Ereshkigal · 30/03/2019 14:12

Unfortunately, despite several approaches, the papers failed to print it.

Wow. Surely that's edging close to discrimination itself?

McTufty · 30/03/2019 14:18

Exactly. I have no idea how Stonewall etc have got away with outright lying to people about what the law is.

They are free to campaign to change it but should not use their proud reputation to mislead as to the present position.

Datun · 30/03/2019 14:23

Excellent clarification.

Chaotica · 30/03/2019 14:24

That's a really useful letter. Thanks for posting it.

McTufty · 30/03/2019 14:27

Stephanie I know you’re reading as you’ve tweeted that this is wrong - please would you engage with me in a civilised legal discussion between lawyers of why you say this letter is legally incorrect?

barelove · 30/03/2019 14:27

Red Yep, I've printed it and stuck it above my desk to remind me that there really are legal facts to refer to (as opposed to the fantasy that has spread like wildfire over these issues). Seeing this daily will remind me that sanity can prevail Smile

KatvonfeelzlikeaMAN · 30/03/2019 14:41

That's very useful. So many organisations need to see this!

Datun · 30/03/2019 14:43

Of Stephanie says that's wrong, presumably they will clarify on Twitter.

McTufty · 30/03/2019 14:48

datun

Maybe but I never tweet and would like to be able to respond and engage with what Stephanie says so I hope she will do so with me here.

HawkeyeInConfusion · 30/03/2019 15:05

Thats a useful letter.

I have previously stated some of the points in an email to Girl Guides. They ignored most of the points in my email stated that the had been told that legally they had to accept boys identifying as girls. But if they got their advice from Stonewall them of course that is what they would have been told.

LizzieSiddal · 30/03/2019 15:08

Could Stonewall/Mermiads etc be legally warmed that their training material is —lies— incorrect?

ThePurportedDoctoress · 30/03/2019 16:07

told that legally they had to accept boys identifying as girls

Who told them? GG won't be able to pass the buck to Stonewall when shit hits the fan, because Stonewall has no legal competence.

CharlieParley · 30/03/2019 16:11

Stephanie is wrong of course, given that the EHRC was forced to issue a statement last year correcting their earlier misrepresentation of the law that purports that self-identifying males hax the right to access. They didn't, alas, change their guidance to businesses and service providers in line with their clarification, choosing instead to quietly delete some of their most egregious errors.

CharlieParley · 30/03/2019 16:12

^have not hax

JackyHolyoake · 30/03/2019 17:13

Thankfully, others have been consulting with lawyers too:

Thanks for posting that jacky - I'd not read that, and it's really excellent. Well done to FPFW on putting that together.

Amoregentlemanlikemanner · 30/03/2019 19:06

Would anyone be kind enough to type it out? (Hard to read).

Any busy solicitor or barrister prepared to spend precious time debating the law with Stephanie deserves a medal.

happydappy2 · 30/03/2019 19:37

From SH on twitter
The #transgender hostile extremists are now banging on about gender neutral toilets. How do the #Nuttersnet crew cope when flying? Can see it now aggressively rings call bell and demands cabin crew find a single sex (based rights) toilet 11,277 metres in the sky!

Hugely missing the point, that onboard aircrafts we KNOW the bathroom facilities are used by both sexes, but are so tiny it is generally one person at a time. (Though have squeezed in with a child before.)
