DS 17 got arrested last night

DS 17 was riding around on his motorcycle last night with a friend on the back. They had smoked some weed. A police car was behind them and the friend put his hands over the number plate and he tried to out run the police car.

They eventually got hemmed in and stopped. The friend ran away and my son was arrested and spent the night in the cells. He has been drug tested which will come back positive, he has been told he will face a driving ban for 3 years. He has also been told if he tests positive for drugs (he knows he will), he may go to prison for a year.

I’ve cut my holiday short to come home but I just don’t know how to respond to this. Is there anyone else who has been in a similar situation?

The suggestion to get a good lawyer isn’t really going to work if the family doesn’t have the money to even recover the bike. Good lawyers cost significant amounts of money.

He has to pay £150 to get his bike back which we don’t have right now which is why he’s getting the bus tomorrow

So if he had his bike, you’d let him use it? If my 17 year old did this whilst living at home, there’s no way he would be allowed to use it.

You wondered why someone was asking if you were going to give him the money to get his bike back, probably because you’re saying ‘we’ don’t have the money at the moment rather than it being him not having the money.

I'm sorry he's causing you so much stress. He needs to find out what the daily storage charge is & how long he's got until they sell his bike. Maybe he could ask for an advance on his wages.

I don't know how he can legally get it home as presumably he's no longer insured?

try to resist taking him places and making life easier. He needs to feel the consequences of the ban, but at the same time he needs to know you support him & love him.

The OP hasn’t clarified whether he’s informed his insurance company. If he doesn’t cancel the policy himself then for the rest of his life he will have to answer “yes” when asked whether he’s ever had a policy cancelled. This likely rules out getting insurance for anything for a few years, then a lifetime of significantly elevated premiums.

OP, he really does need to sort this out straight away. Once his policy is cancelled he’s not going to find anyone else to cover him while the bike is impounded, and without insurance it is not going to be released. He needs to raise the money, get the bike home, cancel his policy himself, and then get the bike sold.

Check they acted appropriately re the interview but otherwise nothing you can do.

Haha channel 5 was my first thought . I hope he gets the book throw at him , absolute user no doubt in a cheap tracksuit , scrawny with a bad haircut . Absolutely hate these anti social teens either making life a misery or hurting someone

If he's living at home, you need to start charging him more rent.

You can by a bike for £400 tax £20 a year insurance £35 a month weed starts at £10 .

I too detest anti-social people, but I think your assessment of the OPs son is a tad unfair. Let's not forget a fair few city types, actors etc (ie those NOT wearing a cheap tracksuit with a bad haircut) are also users.

We know nothing about him, nor the OP, really. Judge the deed, not the doer (in this case).

When is it 18? It will only be dealt with in the Youth court if he is under 18 at time of the court date. I would really push to get it in court before his birthday.

I am a magistrate both in youth and adult court. The approaches are quite different.

As a PP said, drug driving is different to drink driving. Drug driving is an over the limit or not, there is no x times over the limit in the same way as drink driving.

We had a case today when the offence was last December and the drug blood tests only came back in April. So they do take a long time. I would talk to the police about timescale and getting to court asap.
