Some boots i bought 2 months ago from Next are FECKED. I don't havce receipt. Should I bother returning htem?

They have split on teh side, where the stitching is

they have a split in teh SOLE fgs

I've had them 2 months

I have had the same problem - but I got mine from a Next outlet place so wondered if they were seconds.... Was very annoyed as I had really liked them (similar to those Fly boots)

I never got around to returning them - didn't want to trek all the way there to find out they had some get-out clause. But if you bought them from a regular branch I think you should try bringing them back

did you pay with debit/credit card as they can take the statement with transaction on as proof of purchase?

Yes take them back. They are not fit for purpose! How did you pay? If it was card they'd be able to track it anyway.
Make a scene, tell them you will contact HO, you will contact trading standards, you will tell all the parents at school, fb, twitter etc etc that Next are shite and so on

Paid with bloody gift vouchers.

Not feeling very brave today, even though I'm going to where there isa Next.

I need a kick to encourage me I thiknk.

I can't tell DH as I sneakily bought the boots "...these? oh I have had them ages..."

They will know they were bought this season so must be less than six months old - boots should last longer and so yu should take them back and insist that it's not good enough. They'll only offer you vouchers I expect but that's ok. Also - be clear on how much you paid - if they were in the sale they will try to give you less back. Just say - these boots are not fit for purpose I expect the price I paid back.

i got told that a debit/credit card statement is not proof of purchase. as it only shows that you have spent a certain amount of money in the shop, not what on. is this right??

bank statement is proof that you purchased in that shop at that time, all they then need to do is a transaction search for around that time and they should find your transaction.

Take them back, but don't say they were a gift or you have no remedy in contract/ under the sale of goods legislation iirc.

Not of satisfactory quality (as a consumer you're entitled to expect they would last longer than two months).

Burden of proof squarely on them as less than six months ago. You'll have to give them the repair/replacement option. Given last season, repair may be feasible. All in all, less hassle to give money back.

take them back. They cannot refuse to exchange or replace within 12 months and they will know they sold them, they are clearly their boots.

I took a tv back to sainsbury's outside of it's warranty and got a full refund as it was hardly used before breaking (bedroom tv 15months old).

My MIL took a pair of shoes back to the shop 3 years after she bought them with no receipt, and got a full refund (admittedly she did argue for a long time and cause a scene first).

Take them back at the weekend, and if you paid by card, take your card statement with you a proof, if not, i don't think it matters.

oh yes, they can search transaction. They did this for me at Argos for a broken airmattress too, they gave me the til number and everything at their customer service and I got it replaced (i have done well haven't i? )

We bought DD a raincoat from next that the hood split on after about 3 months of use - took it back and they happily replaced it with no recipt. They were really good about it.

Yay I was brave and they refunded me with no quibble! they did refund me the sale price, but I'd bought them in teh sale so that was fine.

Oh, got it on a voucher card, but that's ok, I'm just pleased they weren't arsy!

Out of curiosity MamaG, why did they only offer you the sale price (or last selling price)? Was it because you told them you bought them in the sale?

next boots are poo IMO!! i bought a pair of high heeled boots a while back and didnt get a chance to wear them for over a week (what with work being in a hospital so no heels allowed) i tried to put them on for a night out and the zip was stuck. i took them off and they only had one side of the zip attached and the other half was in the box with the other boot!! i took them back and they refused to refund me as they couldnt be re-sold i did eventually get a gift card and an apology letter from the head office but was left with a very faulty pair of unwearable boots and out of pocket £40 and i had to fight them tooth and nail to get a response

Next quality, like so much else, has nosedived over the past decade. I still have some leather boots I bought there about 8 years ago which are going strong having been resoled/ heeled several times.

V disappointing.

As others have said, the boots clearly are not 'fit for puyrpose' if that's happened after 2 months, and you are legally entitled to a refund, receipt or no receipt. You only need to produce a receipt for a goodwill refund - i.e. where there is no fault but you just change your mind.

PandaEis - If the item is faulty and within a reasonable timeframe, you are entitled to a repair, replacement or refund. Whether they can resell the item is irrelevant. They can ask for proof of purchase, but rarely do so.

As you mention that you're £40 out of pocket, I assume the giftcard was not the full amount you paid for your boots? If this is the case, I would report the shop to Trading Standards, quoting The Sale of Goods Act 1979 - you can find many sample letters online.
