Crumpet ceased trading - no refund!!!

I bought a few things from their online outlet before Christmas which I returned as they did not look the same as they did online. I received some crappy modal scarf in the post this morning from them with a credit note as apparently they have ceased trading and will not be honouring refunds! Is this legal?

I am so pissed off.

No idea about the legalities but wtf use is a credit note if they're not trading anymore?

The letter says that "a team of angel investors have purchased crumpet, within a new company: crumpet cashmere ltd", you will not experience any change in the manner of the day to day operation yada yada.

They say they do not have to honour the refund owed by "Crumpet England Ltd".

Now I am a huge Crumpet fan, but I think it's shocking that the website is still taking orders and there is no mention of this anywhere that I can see. There isn't even a change to the returns policy. I placed an order when the sale started, but I'm glad that I loved everything. This would have really p*ssed me off!

That's dodgy as hell.

I don't rate their quality and had issues with them trying to not give me a refund on a sale item last year. Luckily I got stroppy and started quoting the distance seller stuff and they relented but I was left with a dislike for the company.

Well, I guess that as it is a different company there should be no problem with orders placed now so they don't have to say anything on their website - it will only affect orders placed when it was "crumpet england" rather than "crumpet cashmere".

Needless to say I think this is pretty shoddy and I will be spending my voucher on something I don't really want and then never looking at them again.

Sounds like they've run the company into the ground, started again with a slightly different name which is dodgy as dodgy can be. Bet they've got loads of angry creditors/suppliers too.

Mrs CB I had exactly the same issue with Crumpet last year. Bought from sale and they wouldn't accept returns at all which is just not legal in the UK.! Sent off trading standards letter and eventually got a refund but like you it was one of the places I wouldn't buy from after that.

It sounds as if they aren't to be trusted in any way. bigredbook I think you should call trading standards - google them. They were really helpful last year.

Such a shame - it's one of those companies you'd like to buy from as it's uk based and all that

Don't worry about the scarf as I'm sure you'll love it (they are gorgeous and a bargain in the sale)! Sounds like they have a bit of a scam going on though.

If you paid with a credit card you should be able to do a chargeback for goods or services not received - contact your card issuer.

doesn't that credit card thing work if it's more than a certain amount you spent - like over £100?

you can use chargeback where section 75 does not apply, so for purchases under £100 for example

Within 45 days you can raise a PayPal claim and they will refund you. You may have to return the items tracked and give PayPal the tracking number.

So is the voucher for the new company? I'd seek advice about that. I thought it had to be clear cut - either the new company is entirely separate, or they are taking over from the old companies obligations. If they gave you a voucher, you may be able to argue they are accepting liability and therefore should refund you.

Caja, I returned it, the refund bounced (through Paypal) and now I have no goods and no refund. I'll send Paypal a message and see what they say.

If they're still operating a live website that's taking payments, contact trading standards, as they are breaking the law if they trade while insolvent.

How much did you spend?

If it was over £100 which isn't hard with that company I'm wondering if you could go down the chargeback/section 75 route if you funded the PayPal payment with your credit card. I don't think this will work if you paid using a Paypal balance though.

When you say the PayPal refund bounced what actually happened? I think you can go into PayPal and open a case that the goods have not been received. However if the merchant has withdrawn all their funds from PayPal I'm not sure this would get you your money back as I think PayPal normally refund by freezing the funds in the sellers account and then returning them. Not sure if they will make good out of their own coffers if no money left in the sellers PayPal account.

It might be worth posting on the eBay board as there are a lot of people who understand the ins and outs of PayPal and disputing transactions. My understanding is very probably wrong/out of date/incomplete
