Thank you for all your support I am just feeling tired star after doing all the paperwork, responding to the late working document, highlighting the relevant bundle bits, and writing my opening statement and arranging for childcare for the kids after school tomorrow!! I will let you know how it went ASAP!

Glass of warm milk in you. Off to bed. Try and take some water and snack for one or two of the many 'breaks' to keep your energy up.

Best of luck.

Oh, and if you get a loo to yourself during the hearing, run up and down on the spot to release tension and refocus your mind (unless you are wearing high heels obviously)

wasuup3000 · 25/09/2011 22:10

LOL thank you star you made me smile x

good luck for today!! Go nail it! I have a tribunal coming up soon so will be interested to hear about your experience..

tiredoffightingwithjelly · 26/09/2011 17:54

Hope you are ok wassup I have been thinking of you today

wasuup3000 · 26/09/2011 18:08

It was positive I think. LEA got told off a few times for various things, like only producing the working document on Friday and not getting up to date reports folloing the new diagnosis.

Anyway after part 2 we went for a break then the judge decided to adjorn because he thought that untill they had up to date reports then there was no point doing part 3 just yet.

SO he ordered the LA to get new reports and set a date to return to tribunal if we needed to and still were not happy with the statement.

Had a chat informally afterwards to discuss part 3 with LEA and they decided that before the next hearing despite what new reports might say that they would ask the county's moderations panel for more funding........

Oh and while we were having a break before we had the last informal mereting with the LEA the clerk to the justices came in and said to me "I hope you win"! The SENco was sitting in the room at the time but the clerk didn't see him...

Thank you for all your thoughts and aspergersrus it wasn't too bad when I got into it.

Oh fuck off stupid tribunal panel.

Why should your ds have to fucking WAIT EVEN longer for his provision because the LA are crap. That is the whole POINT of you going to tribunal.

Hope so much that the tribunal panel have done this to a)give them a chance to GET IT RIGHT and b)look fair when they give you your win.

StarlightMcKenzie · 26/09/2011 18:14

Were you not in tears leaving without a resolution?

I was when it happened to us, but I guess that is how it is.

Very well done to you Wassup. You have done what most parents cannot. Brian Lamb himself says so. Please be bloody proud of yourself for what you have done.

wasuup3000 · 26/09/2011 18:18

It's because since my daughter's ASD dx they (the LEA) haven't got any new reports on her needs looking at it from that point of view. The tribunal has given the LAE 3 weeks to get OT to assess, speech therapist to assess and a specialist Autism teacher to assess and told the LEA of for not soing this 6/7 weeks ago. The tribunal were pretty annoyed with the LEA.

What did come out at the tribunal was the School SENCo had been taking an hour of all children who have statements to put for specialist school transport for trips and specialist equipment such as laptops.....

tiredoffightingwithjelly · 26/09/2011 18:23

Well done for getting through it wassup, so sorry you have longer to wait and I agree it does give the LA time but at least there appears to be recognition that they have not acted appropriately, I really hope you get what your daughter needs as a result. Please keep us all updated and hope you have a nice glass or two of something tonight to destress for now.

I hope they stay annoyed at the LA till the next hearing and beyond!

wasuup3000 · 26/09/2011 18:25

Thanks, me too!

wassup we cross posted, I cannot believe what came out about the senco, that's absolutely disgraceful, how on earth did you get them to admit that?

wasuup3000 · 26/09/2011 18:31

He's not the brightest and just came out of it when we were meeting the LA afterwards to discuss part 3 and to look at staffing levels.

The LA officer was less than impressed.

The school is now an academy and the SENco was told to this by the finance manager.

The LA told him he needed to meet with the finance officer and tell them he is not to take the money from the statements for these things. The school have their own budget to manage now and are not under LA control.

It is rubbish and I have 3 kids with SEN to go through this. Am starting the tribunal process again for another child this week and I can imagine that soon I will have to start the statement process for the youngest..
