Rant away I feel pretty much the same just having to start it all over again with my 3rd child fills me with those same thoughts. He was born with two rare defects one to do with his cord and one to do with his pacenta, he could have been born still born basically, so although he is hard work (being assessed for ADHD and scored really low on recent OT tests for dyspraxia) I am really pleased that he is otherwise healthy.

What a pita not getting a resolution. But jolly well done for getting through it, and it sounds like the LA are rubbish enough that your case is even stronger. And you know, after all the time/stress it takes to get this far, another few weeks isn't that long to wait.

Will you see the LA's reports before they are submitted?

Agnesdipesto · 26/09/2011 21:00

Well done wasuup if you come out with no regrets then its clearly gone well.
You can ask for wasted costs - should be on sendist website or look up civil procedure rules. In effect the tribunal have told the LA off for causing the adjournment so you can ask for the LA to cover the costs of having to attend twice / extra work due to new evidence late in the day eg having to prepare for a 'final' hearing twice. Be relevant if you have childcare costs, travel, hotel, legal, witness fees

wasuup3000 · 26/09/2011 23:09

Hi Bialy and Thanks! Yes I have 2 weeks to look at the reports before it goes back to tribunal and too look at a new working document if there is anything that needs inputing.

Thanks Agnes will look at that!

Wassuup I am gutted for you that this has happened...after all if it was us that never presented our Ind reports we would not get another chance....is this a case for appealling I wonder if you don't get everything?
But on another note this all helps when they are so rubbish and not have reports in first place....maybe tribunal just making them do reports so LEA cant do the appeal thingy instead?

That is awful that the SENCO is using statement funding for trips and laptops....good press cover I say....sounds good though LEA said requesting extra funding....maybe they will bowdown now before next hearing??? Hope they do.

Like tired said I too had to threaten JR three times after winning 2 tribunals to get what was on their! I just told them now this 4th time and they are okish with me and did it before solicitor letter :)

Have a rest and a few Wine and [chocolates] to destress for 5 :)

tryingtokeepintune · 27/09/2011 08:45

Wassuup - oh no! Another delay.

Glad you are feeling okay about it - sounds as though it went the way you wanted it to. At least you will know roughly what to expect when you next meet. Hopefully the LA will agree to you requests by then.

Hey, how did your ds's grammar entrance exams go? Was he happy about it?

wasuup3000 · 27/09/2011 10:14

The delay is because the LA's working document is so poor and doesn't relate to dd's new diagnosis, the LA just stuck the word ASD in it here and there as an afterthought basically if the LEA haven't presented a decent working document within those timescales that we agree on they will have to explain that to the tribunal who were not happy with them at all for their previous delays.

He did his best trying, he said that he found some of it hard and some of it easy. They don't get to know their scores just if they have met the required standard, so if there was a high percentage of really bright kids that took the exam the bar is set at that target mark.

The schools are all OK around here (for non SEN kids) so it doesn't matter too much either way, we just didn't want him to have that "what if" thinking if he hadn't of had a try.
