If you have a written submission - obviously you are going to have to respond to the LA new evidence - but tbh the tribunal should have stopped it - ok you had a legal bod there but many parents wouldn't have and its not much use saying well you will have 3 days to reply as if thats enough time for a parent to become a legal expert.
Its a downside of having a legal rep i think - if you had gone on your own maybe they would have told them they could not spring late evidence on the parents?
Its a dilemma we have wrestled with - we are bringing an advocate but are aware it ups the ante
But when you put in your submission you should sort of sum up your case - a skeleton argument if you like - of the 4-5 main points
So your Dh is right don't get into the detail just say I want ABA because - it works - he's made progress - the alternative doesn't work - they don't have the service to deliver what they say etc whatever your main things are and just refer to the main docs which support you but keep it brief aim for 1 page of bullet points
You just need to cut through all the crap and take the panel back to the central arguments and make sure thats what they read last.
But we've been told 1 day is enough and our case is similar
And TBH it is enough if stick to the point.
Sorry this is dragging out for you.
If our LA get wind of this tactic they will definitely do the same.
You can also put in a claim for costs of dealing with the written submissions and ask the tribunal to award costs against the LA
If the tribunal are p**d off as you are they probably will penalise them for dragging it out / being unprepared.
It was the tribunal fault too for allowing them to change legal reps at the last minute
Try and keep going. Know how hard the last few weeks must have been and you must have so being looking forward to a summer off.

Well i think thats really out of order as you didn't have a lawyer
So much for being accessible by anyone
Brian Lamb was right we should all get Legal Aid for this
I would think if they name a placement in August they have to let him go in Sept or hold it until you have the support in place eg let him start in October or whenever
Can you ring the school and ask them what the position would be based on the possible outcomes?
looking on the bright side maybe next years annual review will be too late in the school year for them to name anything other than what you have asked for .
