Hi there. Trying again as I haven’t seemed to have gotten an answer, so I applied for the benefit cap to be lifted a while back due to being in an abusive relationship during the time of my youngests conception. I've recently recieved a message saying they've overturned their decision and i will be exempt from the benefit cap from August 2019. Has anyone else had this? Will the money be backdated? If so does it take long? Many thanks

@Thelonelychicken are social services still involved or do you have an idva? Surprisingly the forms weren’t too invasive x

@LangClegsInSpace no, nothing at all. Ive also been paying debts in the thousands that he ran up in my name with no way of getting out of them so in my head I'm daydreaming of back payments now so I could clear some. Wishful thinking probably, but it's a nice dream to have.
Jobcentre, CAB, women's aidcetc have never mentioned this.

@Thelonelychicken @Sux2buthen to be fair when I went to the refuge and was filling the forms for UC they said that I wouldn’t be able to claim 3rd child because I wasn’t raped. Maybe it’s a newer thing with the controlling and coercive behaviour

@vicki6158 crikey, that's such a loaded guideline I expect they had to change it. I mean theoretically, if you're being controlled you're possibly unlikely to be in an enthusiastic physical relationship so it's not straightforward.

No the controlling and coercive behaviour exemption has always existed since the cap was brought in! Just most advisors don't understand the rules! Its like the work coaches at the job centre for UC; sometimes you have to state the rules to them!

Social not still involved. But we've a non molestation from the court. I've read the guidance and my health visitor can sign it if I remember I'll come back and update on how it goes. I thought it was only rape as well didn't know about the control part.

Hi again. So, I have the form (it's a horrible name for a form and nearly put me off)
I'm just concerned because the third party section asks the professional to say they were aware of controlling behaviour at time of conception but I don't think anyone did until after the event. Did anyone here have the same issue?

@Sux2buthen i think they just need to say they know it was happening even if it was prior to their involvement. Nobody was involved until I left

Ok that's eased my mind a bit. I suppose it makes sense that most wouldn't be telling services straight away. I always feel wrong about trying to get support but that's me just being daft.

@Sux2buthen i have started receiving the 3rd child allowance now. I asked about a backpay but they said something along the lines on the benefit cap cancelled out anything they owe me. I tried to argue it but I gave up. Would have been well good. I’m just glad to get a bit more support though.

That's a shame, it seems only right to back pay it given that they dont tell people openly it's available. But, I'm glad you're getting some extra support

If anyone is thinking of applying; you need to complete the NCC1 form (which you can download online) and a third party needs to fill in a certain part

Mines been approved too. I now get for the 3 kids instead of 2. No back dated payment but happy to be getting the extra.

It takes a while to sort and they lost my form for a while it was a long slog! It's worth doing

i filled mine in yesterday uploaded it and got awarded £6338 payment on way for twos years but my child is 4, im so grateful to get anything but surely they accept back payment or they dont not half ?
