Hi Everyone

Forgive me if this becomes long but I am really upset.

Two weeks ago I received a Notice of Intended Prosecution for an offence I do not believe I was involved in. Following 2 calls with the Central Ticketing Office I returned the form completed, confirming I was the driver but with a letter requesting further information and evidence as their letter didn’t actually show me the offence it was alleged I had committed. I still have no recollection of this, but of course this letter was mortifying and I complied with their instructions to return within 28 days. I have since received 3 emails from the CTO to say they have not received my documentation and my 28 days is nearly up. I returned everything to them over a week ago now via First Class Recorded Delivery. It was signed for the following day which I have a signature for, however the Police are saying they haven’t received anything and that the tracking is irrelevant, and can I send the originals again. I have stressed how can I do this as I have already sent originals, photos and letter and I have proof of delivery.

I haven’t heard back from them yet but I am really upset about this. I have even had a friend, who has a traffic officer friend look at the NIP for me and I was told the photos are very strange and don’t show anything, but to send the completed form back, which of course I did. What upsets me more is I have no recollection of anything taking place. That particular journey I had my Mom and son in the car and not one of us saw anything. I am a single parent, of good character. I do not go around breaking the law. I have never had a flaw on my driving record. I genuinely do not feel this has taken place but after seeking legal advice I have been advised it is very rare these things are overturned so to just to accept. This upsets me as I feel it is a flaw on my character and I can assure you if I have done something wrong, I would own up to it. I have admitted being the driver but I honestly don’t know what took place during the alleged offence, but I can remember every detail of the day even down to the customers I saw at work and what I spent to the penny in shops, but I have no recollection of committing any offence.

And now they are asking for originals to be sent again, when RM have confirmed delivery of on 29/03/18. I feel like im being set up. The next step I have read is that I will be issued a court date for not sending back requested information, and my fine and points will increase for failing to comply.

Can anyone offer any advice here? Thank you in advance

Is this from the Council? I thought they dealt with ticketing offences. It should detail where and when the offence took place, and what the offence is. Why would the police deal with this?

I got done for being in a bus lane once - hadn't a clue as was in a strange town till the ticket came through the post. It was all laid out clearly - where, when, why and with a pic.

they don't need to provide you with a photo that shows you - think this is a common misconception

Sorry - is this a speeding offence? If so the police would deal. you might have been caught by a static camera

i don't see what your defence is apart from ' i don't break the law' which wont get you very far

You were either in the car, or someone else was driving, in which case you name them.

Very strange that it’s signed for but they don’t have them. I don’t see how you can send the originals again either.

I suggests I failed to comply with a stop sign, however I have taken photos of the area and also contacted the council, and in both cases I can confirm there are not any permanently or temporarily in the location. The three photos provided just show a cropped photos of my registration, and the others of my car proceeding on the road but nothing else. Even if they cant provide me with further details they are denying receipt of my forms which I have signed tracking and confirmation for

Caroline680, im guessing you are pretty much telling me it is my fault but you are missing the point of my post. I have not denied I was the driver. I am not trying to get out of this by saying I am of good character and a mom! Do you really think I am that silly! I have complied.They are saying my documents havent been returned when Royal Mail have proved they have

Have you got details of who signed for receipt of your documents?

If they prosecute, you can presumably produce your confirmation of receipt of your form and your evidence about the lack of stop signs in the area. You can also reasonably point out that the evidence they have sent proves nothing more than that they took a photo of your car on a road.

So they are saying you failed to stop at a stop sign, and have given the specific place where the stop sign is, and you say there is no stop sign there? Are you sure you have not misread the location?

Was there a stop sign written in the road? These also count as mandatory stop signs. Is it a junction?

Just a thought....this isn't a scam is it? There have been reports of bogus speeding ticket, aimed at getting your bak details. Have you checked the address/email that you are corresponding with?

I was able to match the background of the photo so I know the location is where they said. I have also photographed the road for any road markings. It is a normal road outside residential properties. No solid lines or red markings.

And yes I do have a date, and signature to produce, which I have already provided but told this but told it doesn't mean anything

Email or post the following:

'Please find attached a receipt for proof of postage/screenshot of delivery receipt (or whatever), confirming that I returned the requested documentation on xxxxxx date, well within the 28 period. If you are still unable to locate it, I am happy to complete the form again. Please confirm the deadline will be renewed.

Well everyone told me it was a scam, but I genuinely believed it. And when my friend's Police Officer friend who said the working and address were correct, and the fact that the CTO have it logged so I doubt it is a scam

@Raines100 That is exactly what I sent them earlier. I dont expect a reply now until next week, when the 28 days from issuing will be up.

This isn't me trying to get out of a ticket. I have been compliant but I am still being told I haven't done as requested

Have they cocked up and confused you with someone else. Are there CCTV cameras, near the stop sign, why would they try to make out you broke the law if there was no accident or bobby on the beat (fat chance) hanging about watching for this.
Send an email and recorded letter as suggested above and wait to see what happens - probably nothing.

It is very easy to get done for something and not see anything. I got done by a policeman with a handheld going 36mph in a 30mph speed limit - I never saw him!

OP, what is it you need advice on? Surely, you will have to clarify this with the police. No on mumsnet knows if there is or ever was a stop sign at the end of an unidentified street somewhere in the UK.

The advice I was actually looking for was not situation specific but if any one has had experience of the Police denying receipt of documents that Royal Mail has tracked as delivered, and if they can really prosecute me for not returning them when I can prove I have. I have just gave you background of the NIP! I do not expect opinions of my actual journey or the road but the fact that the Police are denying receipt

Sorry if my post as been confusing, my issue with having no knowledge of the incident is something I have to deal with with the Police.

It is the denying receipt that I am conerned about as this could land my in court with alot more points and a much bigger fine when forms have been returned and signed for

I would write a letter to the place you sent the last one detailing what has happened and including a photocopy of the proof of receipt for the original letter/forms and asking them to resend the forms to you to complete again. This way you will have a paper trail showing that you are trying to comply. If it is possible hand deliver it.

Do you know the name of the person who took receipt of your letter and signed for it?

Yes there is a clear name printed and signature. And thank you, I will send another letter in the post in addition to my emails
