I know the last thread was removed because there was too much speculation and I get that. I believe a lot of people shared a lot of personal stories and experiences which were important and gave powerful insights. Would we be able to continue the debate without the speculation (start your own topic for that) and instead just continue to debate where cases like this need to change going forward, how court processes can change as a result of such difficult cases and what lessons can be taken from this awful case without it being a thread about a thread? It would be a shame to lose being able to discuss every other aspect of an important debate just because one aspect of it is problematic for MN. Is it even possible to continue debating the wider implications thrown up by a case like this? If it's not then my all means MN please delete. 🥺

I don't. I don't think legal aid should be available for cases like this. It was clear from the first court decision that Dance's position was wholly unreasonable and untenable.

Given that the Court of Appeal upheld them the first time around, that wasn't clear.

But the main point is that if Legal Aid was available, it would help to keep desperate parents out of the hands of people like CLC. A lawyer would still have a duty to push their client's case to the best of their ability, but you wouldn't get the nonsense you had with CLC of putting out inflammatory press releases and statements, and some of the wilder legal claims (e.g the one about the wrong scans having been produced) wouldn't have seen the light of day. People never seem to realise how much of lawyers' time is spent in keeping hopeless and time-wasting claims out of court.

Everyone does and should have a right to challenge. And it should be fair so the justice system is a good way to go.

The issue is when 3rd parties with an agenda get involved and chew up and spit out families at their most vulnerable.

I do think HD personality would have a part with her involvement with this and the things she said but a 'proper' lawyer would give better advice and defend without bias on their clients instructions.

CLC aren't registered lawyers and therefore they can't instruct barristers on behalf of clients. The law reports show that two other firms were involved, and someone said that Pawel Stroilov who works with CLC is employed by one of them, but I don't think anyone knows how the relationships and any payments worked.

I've read on Twitter that the family are now suing the hospital. Where will the funds come from for those legal fees? Will it be the same company representing them. I couldn't see anything on the bbc about the suing so I don't know the full story.

Don't believe the suing though has said still believes they were wrong but she has said she wants a inquiry over how everything was handled and a change in law..

Her interviews seem to be losing more and more support especially when she has talked about her last words to him etc. But she has said she won't stop doing interviews so unless the media stop which guess will eventually.

I think she'll find it's not really her choice. The media will become progressively less interested in doing interviews with her.
