Divorce through Bury St Edmunds

Hello

I was wondering if anybody else is currently using this divorce court and can give me an idea of timings please as they are very vague....

The petition was accepted and paid for beginning of May

The respondent signed her bit and returned end of May but they are still saying it is not registered in the system and i should give them another 3 weeks before calling back...?

I also asked how long a DIY divorce takes (no children or financial affairs and have been separated over 5 years) and they were very vague quoting anywhere from 6 months to a year!!?

Anybody got first hand experience please?

Sorry to act thick.... this is the EM Court email response

My Court order was sent and was denied by the Judge as they wanted more information.

It was resent back to the Court on the 29th June. Which one of these applies to me?

"Processing" is so mealy mouthed!

Take decree nisi applications. They are 'processing' applications received 15 July. Wow! What that means isn't what it sounds like. In terms of actual progress, what it translates to is "Bibby's firm is this week receiving the outcome of DN applications sent to court in the last week of April."

I conclude that "processing" means "taking payment for, logging on the computer and sending upstairs to the judge/judge-substitute /downstairs to typing ". Not, you know, doing anything remotely useful.

Started in October. Got the nisi confirmation in June but still no absolute. There's been no mistakes and no disagreements with ex, so it looks that this is simply how long it takes

They should have sent D36 form for you to fill out to send off after the 6 weeks 1 day. to get the absolute.

Phoned East Midlands divorce court. My Consent Order was sent to them on the 30th June. They are currently processing the ones received on the 20th.... so he said it will another 4 weeks at least Sad

I'm going to be absolutely devastated if it's refused again. I just want this hell over with.

GreenandBlueButterfly · 18/08/2018 17:43

I got the absolute this week. It has taken just over 4 months since I filled in the forms, and 9 weeks since I got the Nisi

BSE: Financial order sent to Chelmsford 5th July, agreed by judge 23rd July, received by solicitor 15th August. Application for Decree Absolute sent off 16th August. Solicitor received documentation today, 20th August. 28 days now to finalise financial arrangements. Decree Nisi was granted at end of last year - delays due to two parties agreeing finances, one being uncommunicative and refusing to use solicitor.

Do you have any updates Smiler06?

Report
Smiler06 · 31/08/2018 09:24

Morning everyone!

So finally got a bit more information when we called BSE yesterday!! It has been to the judge on the 9th August but they won’t have an answer from him for around 5-7 weeks and then it will take them a further 4 weeks to type up the answer to send to us!!!! Therefore it looks like we won’t have an answer from the judge until around November!!!

Current timescale

Apply and pay - beginning may
Respondant sent straight back - beginning June
Application for Nisi - mid July sent straight back
Went before judge - 9th aug
Expected response - November...

Let’s hope it’s good news!!!!

Does anyone know, if the Judge approves it do we have to wait for it to be written up or do we get notification that it's been approved?

For weeks.
