Update to AIBU to refuse Aunt's fwb claim on her estate.

Posting here because it is where I put the first thread.

A brief summery is that my Aunt died and her FWB is trying to say that he is entitled to part of her estate because she had asked me to allow him to stay in a house she had invested in for me. Anyway if you want the full story feel free to read what I put on the first thread.

Anyway the main thing is that he is now sueing in the courts. I need a bit of a hand hold please. My lawyers have suggested getting a barristers opinion so I am just waiting for that. I wouldn't even mind if it was possible to just go to mediation but he wants the house for the rest of his life and won't consider anything else.

The house he is living in is not part of the estate, but by op and her sister.

I don’t think this is black and white. My understanding is that the holiday home was a gift with reservations as OP’s aunt continued to use it after transferring it to OP.

He’s too old to be booted out after the judge swallowed a scam that’s too easy to pull. Next question.

I’m so sorry. OP, your troubles could help someone else if you tell your MP what happened. I know that doesn’t help you but given what’s going on with law changes to cohabitation, a letter from you would really, really make a difference in stopping this particularly lucrative elder abuse.

It will probably have to be more or less what he can claim in benefits.

The court doesn't care what I could make from it. They care about about the CF being able to live somewhere.

Also even if I could charge a high rate it would take a long time for the estate to be drained and it leaves me vulnerable.

Yeah. We tried to separate it but it wasn't 100% clear. Given that I played it safe on the IHT forms and said gift with reservation of benefit. It was a grey area.

You should definitely go to Rip Off Britain. I don't think they'd portray you in an unsympathetic light.
And try your MP; you never know what they might say.

MP says they can't do much as it is an ongoing legal case. Not heard from rip off Britain. Not sure i really expect to.

Thank you. I have had a slightly tumultuous week or so but I meant to post yesterday. I have 2 viable blastocysts so hopefully will be able to try and implant in another month or so.

Part of me feels like I desperately want this finished with before I continue but I don't want to put my life on hold.

I just really really hope that it can all be done with before my baby arrives.

I think all of reading your posts wish you well with IVF, also that the FWB pops his clogs sooner rather than later and we all hope you get your aunt's house very quickly.

Thank you. It sounds mean but he can't live that long surely. The house is also wildly inappropriate for aging so at some point he will either have to acknowledge he can't live over 3 floors of narrow stairs or he will fall. I really hope he has the sense to move out before getting hurt.

There's about a room on each. Ground floor has kitchen and a tiny loo, then a living room, the bedrooms and bathroom.

I would hate to live there.

Looks like then I would be free of him. At least if he accepts the offer my solicitor is putting together.

Surely if he leaves because he has/wants to then the OP is off the hook? She didnt kick him out, so it was his choice or circumstances that made him leave.

Absolutely not hoping he has a mild fall that is enough to scare him into moving out, but not enough to seriously injure him
