DLA Tribunal?

I have just applied for a DLA tribunal appeal - does anyone know how long these usually take and how often they’re actually successful?

Heyyy. So mine is via video so I won’t physically have to attend. I think I’m more nervous because I’ve been waiting so long I’ve sent over so much evidence and my DS has his EHCP to back up everything I’ve said along with a diagnosis and doctors reports. It’s funny that the DLA have said that according to their criteria he meets 3 out of the 4 points for HRM but fingers crossed we win. The amount of evidence I have sent should be fun to get through. I sent videos and pictures of everything 😂😂

That’s good- you won’t have the bag search then! It sounds like you couldn’t be more prepared. Good luck! 😊

So pleased for you! Did the DWP appear and did they say anything? Just curious. Go and apply for a blue badge if you haven’t done so already.

No so they didn’t turn up. It was really easy and they were really nice. Well happy about that

Are you going to get a car?
It's a fairly simple process and if you look round often there are deals ww are on out second mobility car and we haven't had to pay a deposit for either
My son gets HRM under SMI, so no special adaptation, s.

Congrats 🥳 super happy for you and your child. Can’t wait for my date to come around already! Really struggling at the moment going out! By your date I should hear around Christmas which would take me to a 10 months since I submitted my appeal ):

We already have a car so not sure if we will. My son is only 4 so we got it based on the SMI criteria. But I will definitely have a look. Thank you x

I am so over the moon. I don’t understand why they make people fight for things we are clearly entitled to. They didn’t even ask me any questions it was all based off the evidence alone.

I don’t think they understand how hard it is taking our children out, without a car I wouldn’t know what to do. Fingers crossed you are successful and you don’t have to wait to long if you need any advice feel free to message me. X

Just so you know if your happy with a new and reliable model and not bothered by make or model or colour etc It's very simple
Our first car was a Vauxhall astra estate and we got it intwo weeks as somebody else had ordered it but then didn't want it
We now have a Peugeot 2008 neither needed a deposit and we also got the second car quickly we were told August this year but got it about 4 weeks ago
Motability are great when our previous car needed repairs we got provided with courtesy cars and a taxi account
Also you can use it as the family car so go to work in it etc .

We had to wait a year for a hearing date, but were awarded a higher rate than previously, backdated and awarded for five years.

Hello, yes so I had the same issue. So the DWP stated because my son can talk and count that he did not meet that point. What you need to do is not focus on the other points because they are already satisfied with them. I uploaded my son’s EHCP which showed he was delayed in areas of his EYFS. I wrote a really good statement, the judge actually complimented me on it as I added legal precedent they didn’t ask me one question and awarded me within 4 minutes. Does your child have an EHCP that you could use? Or reports?

Yeah they said because he can hand led to ask for help, organise the alphabet and numbers 1-10 in the correct order, tolerates kids sitting beside him at nursery that he didn’t satisfy the criteria. I’ve submitted his EHCP, nursery reports (and a statement clarifying behaviours and need for 1-1) report from primary school with reasons why mainstream wasn’t suitable for him and now a report from specialist too. Omg so happy for all the successful appeals 🥰😍its so frustrating that we all have to go through this process I hope the dwp get a good telling off for wasting the tribunals time im still waiting on my date from DEC 24 so hopefully I will get it soon ive asked for a paper hearing as I cant talk under stress I gwt soo nervous im hoping with my evidence EHCP and educational psychologist reports also teachers reports its going to be enough evidence fingers crossed 🤞 for everyone else that is still waiting good luck guys xx

I’ve heard nothing. My appeal was Dec 29 2024. Maybe after Christmas? How did your tribunal go? Long time waiting nearly 24 months all round. How long before did you get notice for tribrunal?

@zoeybrooks45yes, i think ours was 22 months in total. I got notification at end of August this year if I remember correctly.. I had a telephone tribunal on the 2nd of December and won. I'd chase them up if I was you, to make sure you havent been missed. it's such a long wait.
