To want a refund?

I ordered a £8 tub of ice cream from Uber Eats, alongside food from a local restaurant. When the order arrived, the driver told me the restaurant didn’t have the ice cream in stock so instead of giving a refund, they substituted it with 2 different tubs.

I initially ordered a mascarpone / raspberry/cookie dough/biscuit variant as it sounded unique! They sent me plain vanilla and chocolate ice cream tubs instead.

Uber Eats refused to give me a refund as the restaurant gave 2 other tubs which they thought was generous. Aibu? I don’t think the replacement is suitable - I didn’t want those plain flavours, left alone pay that much for them. Shouldn’t customers be given a choice beforehand for a refund if the fancy item they order isn’t in stock?

Except its not the one she wanted..
That's the entire point of ordering food. You get what you want.
She gets to be entitled to spend her money as she wishes.

Chocolate ice cream is vile - I wouldn't eat it. And who wants boring old vanilla when you've ordered an unusual flavour. I'd be very unhappy and want a refund too.

Did you add a note saying no substitutions? I always do, especially for something perishable that it might be impossible for them to accept back.

Or are you expecting your refund plus to keep the tubs?

Entitled? It’s not entitled to want what you ordered and paid for. If you bought a blue dress online and they sent you an orange one would you just accept that because it’s still a dress?!?

I’d be annoyed too, I wouldn’t have wanted the flavours they sent either. You’re entitled to what you paid for, or a refund so I think they are wrong to not refund you.

Well, next time you go out and eat, and order the beef casserole and they instead bring you a cottage pie and extra chips for the side without asking you, I'm sure you'd be perfectly happy. After all, it's still good value ... And you still got beef and gravy and potatoes...

I would not be happy. It's not what you ordered. If they won't offer a refund I would leave a bad review and not order from them again.

Ok, so you go to an ice cream parlour, order the raspberry and mango ripple... And They give you a vanilla and a chocolate instead. They won't refund you. No you can't choose a different one. No they didn't ask you what you'd prefer, they just tell you "well, you have 2 ice creams"

You can't complain.. you still got ice-cream.

I didn’t know about the substitution beforehand, it was a restaurant order not a grocery order. I wasn’t given any option to reject substitutions like you get with grocery orders. To be honest I’m probably just going to chargeback the transaction with my bank.

How is it entitled to order something, and get something else without being given the option/ told you'd get something different? OP ordered a 'boutique' ice cream and got 2 very basic flavours, which there is no guarantee she likes. I didn't you should be grateful to get an incorrect order, I wouldn't be

I love chocolate but hate chocolate ice cream, I agree with a PP that it's vile. So no I wouldn't be happy with that, especially after the flavours you ordered.

I don't think that's entitled.

When I order a takeaway and the restaurant doesn’t have something I ordered, they phone me and ask me if I want a substitute. The restaurant should have done that. I’ve never used Uber Eats so I don’t know their policies, but I don’t think this is reasonable.

I would be unhappy in this instance as I have a chocolate allergy so I would choose my options based on that. Having said that I would have rejected them at the door and asked rheumatologist driver to return them.

If it’s not what you ordered or want then it’s a complete waste of £8 fail to see how that’s value for money

£8 may be loose change to you to others it’s there one any only weekly treat
