To want a refund?

I ordered a £8 tub of ice cream from Uber Eats, alongside food from a local restaurant. When the order arrived, the driver told me the restaurant didn’t have the ice cream in stock so instead of giving a refund, they substituted it with 2 different tubs.

I initially ordered a mascarpone / raspberry/cookie dough/biscuit variant as it sounded unique! They sent me plain vanilla and chocolate ice cream tubs instead.

Uber Eats refused to give me a refund as the restaurant gave 2 other tubs which they thought was generous. Aibu? I don’t think the replacement is suitable - I didn’t want those plain flavours, left alone pay that much for them. Shouldn’t customers be given a choice beforehand for a refund if the fancy item they order isn’t in stock?

So are you happy to keep any subs you are sent regardless if it’s nowhere near what you actually ordered? What a ridiculous comment!

I think you have every right to be peeved. I don't know enough about Uber eats to know, but if no notes on order, or delivery driver, doesn't advise you of substitutions like supermarkets do, they leave themselves open to refund requests.

I think as long as you didnt accept the ice cream and sent it back with the driver, you should definitely have a refund. If you have accepted the ice-cream, then I think thats kind of saying its ok, and you'd have essentially had 2 tubs of ice-cream for free even if it wasnt what you wanted.

They should have contacted you before hand to say they didnt have the flavour you wanted and were the replacements ok.

If you didn't agree to / accept the substitution, then you are entirely within your legal rights to request a refund. You may need to challenge Uber Eats a little on this, and remind them of consumer law (and frankly, basic contract law); I find companies often "forget" the law until they are politely reminded.

Wtf? She’s paying for delivery, they’re not doing it out of the goodness of their hearts.

Have you never had anything delivered? Do you live under a rock?

Ridiculous reply. So if she ordered a chinese but received fish and chips she should just shut up and be grateful?

Did you turn down the chocolate and vanilla or were you not given the choice?

Next time you need to post a letter, get off your arse and take it the recipient instead of being lazy and dropping it in the post box.

I'd not be happy I don't even like chocolate ice cream so it would be thrown in the bin.
