Why no jail sentence for sexual assault on a 13 year old!

I am totally disgusted by the lack of a jail sentence, I'm sure if the sexual assault had been perpetrated by a man, then there would have been a jail sentence.

Drunk dental receptionist who groped schoolboy, 13, and told him she wanted to 'ride him till morning' before exposing herself and waking up 'remembering nothing' after a white wine binge is spared jail.

Berry sat between the two boys and began stroking the 13-year-old's genitals over his clothing before offering him sex and saying she would 'ride you till morning'.

As the shocked youngster and his friend got up to leave, she pulled down her trousers and exposed herself before passing out in a drunken stupor.
The two boys took videos of Berry before getting up to leave. She was identified after leaving her bank card and phone on the bench.

The 13-year-old, who has ADHD, said he was so traumatised by the encounter that he tried to take his own life.

You're wildly incorrect if you think sexual assault or harassment by men gets a jail sentence. At this point even rape doesn't get one most of the time.

It is just shocking, what a disgusting act!

Are you saying a sexual assault of such a level as detailed in the article, a man would not receive a jail sentence! In those same circumstances!

The poor 13 year child, tried to commit suicide....!

It's quite possible a man would have got the same sentence. Sometimes they don't get a prison sentence for rape, never mind groping.

Simply google 'suspended sentence sexual assault' to see the long list of similar cases.

For even more upsetting sentences, try the same search plus rape instead of sexual assault. There are people getting community service for raping 13 year olds.

This event was disgusting and should result in a prison sentence though.

As a category 2 is a prison sentence 1 to 4 years.

From personal experience this is normal a person I know IRL was given a suspended sentence (with conditions such as you must declare any car you have you musnt have girls under 16 in your car or flat) offended again same sentence regularly was caught with underage girls in his car and flat still nothing was done they didn't add another sentence on the end they had all three running at the same fucking time

I knew a man who assaulted an eight year old girl in bed. He didn't get jail despite being found guilty.

I don't think it's double standards. I just think the standards are bullshit.

As others have said, this isn’t because she’s a woman. These sorts of crimes are routinely given similar sentences regardless of the sex of the offender. It’s depressing.

I've been raped twice, even went to hospital immediately after the second time and they refused to examine me and basically just rolled their eyes at me and told me to go home :(

Why do you need to do this? It’s not a competition and there was a man recently who RAPED a 13 year old girl and didn’t go to prison. Such an ignorant, offensive comment, minimising what girls and women face.

I don’t think a man would have been given a jail sentence for this. It’s just we don’t hear about these offences. This was in the news because it is a woman.

Are you the mum of the boy involved? You seem to think this 1 thing is worse than everything else - including actual rape.

If you are, go home and support your son, and learn about what female sexual assault victims go through, and how often male attackers get off.

This isn't a men vs women issue. It's a attackers vs survivors issue and I assure you the legal system does not care about survivors of any sex.

Ok as you obviously have not availed yourself of google here is a list from 2021 of some rapists who didn't get sent to jail. And no, they were not all under 18.

Yes one was a 17 year old man who intentionally raped a 13 year old multiple times

the other was a 27 year old woman who drunkenly groped a 13 year old.

they are different but for some reason you see the second as worse because she was a woman.

a man would not have gotten a harsher sentence at all. We downplay sexual assault and rape so much

And here is just one example that even went as far as an appeal for being unduly lenient ... declined ... apparently it's fine as a punishment for sexual assault of a child

Now you may well disagree ... and I certainly do ... but to start a whole 'if this had been a man' thread without a cursory google. Frankly I think you should apologise for such a statement now you can plainly see it is not true.

It may be worth an appeal for undue leniency ..anyone can do that ... but if it's within sentencing guidelines (see above) then it will be refused.

So now you realise how awful sentencing guidelines actually are, the only other option is campaigning and writing to your MP. I look forward to your update on your reply from them.

You are woefully wrong with regard to men getting custodial sentences. In England and Wales its almost 900 convicted male rapists have been given non custodial sentences including community service and complete discharges, between 2007-2017, and a further 400 since 2011. It’s commonplace. And of those given a complete discharge, only one victim was male, so overwhelmingly men raping women. Not sure what the figures are for Scotland, I imagine the number could be comparable. And as for the quoted case being a ‘bit different’ - despite them apparently thinking anyone under 25 might be too ‘immature’ for jail, they conversely think they’re mature enough to vote and hold elected office, can’t have it both ways.
