NHS trust taking back one day pay for the 19 September 2022 Bank Holiday

Ok, so I work in a community team. Mon to Fri 9am to 5pm. We were off on 19/9/22 the Queen funeral a bank holiday. The building was closed no staff in. No ability to come into work and not instructed to make any other arrangement. This affects all staff eg admin, nurses, OT, HCA

We all obviously presumed it was a bank holiday. Today we received an email, the trust has made a mistake, and won’t pay and we owe 1 day pay for that Bank Holiday off. A deduction will be made of one day pay for the bank holiday.

Now I understand that Bank holiday payment are at employer discretion and there is no automatic entitlement to a paid day off, however my contention is we weren’t offered an alternative option eg take laptop home and work . Now 4 month later we are informed they’ll take back the overpayment

obviously I’ll contact my union for advice
Can I ask other NHS workers did your trust pay 19/9/22 as a bank holiday?

An extra 7.5hrs was added to our annual leave entitlement which we then used on the bank holiday if we were off

Yes we were asked to either work and take a day in lieu or to have the day off as a bank holiday

Yes, ours did.

I'd tell them you turned up for work and couldn't get in so you do need paying!

Yes we got the day as an extra bank holiday. Or those that worked got paid and a days bank holiday back in lieu

Yes was like any other bank holiday so worked and time off in lau or day off

It was considered as a bank hol, those of us on call got a lieu day and those who weren’t on call were offered the day off, or to come in and work in exchange for a lieu day.

Yes and so did NHS England so advise your employing trust to fall in line with that!

We got an extra day bank holiday added to our holiday allowance, to either take on the day or as holiday in lieu.

We got an extra bank holiday added to our allowance, pro rata for part time staff. Our department offers a reduced service on a bank holiday, so if you worked on the day, you got lieu time.

So yes, the trust is taking back 1 day pay.
@CharlotteUnaNatalieThompson We weren’t given an instruction and it appeared to be a BH. Workplace closed no option to come in and no instructions to work at home
@wibblewobbleball that’s v interesting that NHS england advised it’s a BH I’ll need to go have a Google.

obviously, our contention is 4 month later the trust decides it wasn’t a BH . Hmmm

I’ve got a feeling there was a cock up somewhere in the advice trusts were given. We’ve recently had an email about correcting it but they definitely aren’t taking a day’s pay.

My trust gave it as a bh added to entitlement.

I would be furious in your shoes.

Definitely get unions involved.

I can see ACAS advised on 13/9/22 Employers should discuss and agree with staff as soon as possible whether the business will close for the bank holiday
what type of leave and pay will apply if staff are not working the process staff should follow to ask for the bank holiday off, if the business is staying open

I would argue you were ready, willing and able to work and you consider this to be an unlawful deduction from wages which you do not consent to. That's bloody awful!

ironically they do all this froth about well being & retention of staff…then this
no discussion at the time regard arrangements and then imposing a loss of pay

Yup that’s our contention - no alternative arrangements were made no advice given
By closing the service and cancellation of clinics we couldn’t work and weren’t advised to work from home

Our trust treated it as any other bank holiday - time added to your entitlement and bank holiday pay for those who were at work. Im sure they can't backtrack like they are doing with you? thats awful!

BH at our Trust too. They can’t just move the goalposts on this. Definitely speak to union asap.
