Nick kyrgios being sued

I just read that NK is being sued by the woman he complained about during the Wimbledon finals.

he said that she looked like she’d had “about 700 drinks bro” and that she was distracting him between points by talking to him.

she turns out to be a lawyer and is suing him for defamation.

AIBU to think that she is in the wrong?

Why do you think she is in the wrong? Do you have insider knowledge that she had in fact had 700 drinks?

She can give it a good go. I suppose technically it's defamation, isn't it? I think she has to prove it's negatively impacted her financially or emotionally, too? I can't see her winning the case, though.

i think she’s obsessed with NK and this is another way to keep engaging with him.

Talking to a player during points (which she doesn’t deny but claims she was just being supportive) is dreadful behaviour and I’m not surprised NK was annoyed by it and wanted her kicked out.

It can be off putting to players, however I'm not convinced given his own behaviour (towards his opponents and officials) that Nick Kyrgios can take any moral high ground.

If his precise words were 'the one who looks like she's had 700 drinks, bro', I can't see how a defamation suit would succeed. The 'looks like' would be a defence surely? I suppose it might be defamation of her looks… but it's not defamation of her character because he wasn't claiming she had actually had 700 drinks.

Didn't she go to the papers after it happened to say that she was the person who he was talking about and to tell her side? I can't see that it would have had much of an impact on her, surely nobody actually believes that she has had 700 drinks or has suffered as a result of it?

The only reason I knew it was her is because she went to the papers. Also, she offered an excuse - only two drinks but the heat got to her - and an apology, so she’s acknowledged she did something.

Anyone other than Nick Kyrios and I would be sympathetic. As I think that the law of libel/slander is a way for rich people to bully others. Think of its use by Robert Maxwell for example.

Definate money grab. Nick could afford to settle without blinking but I'm not sure his ego would allow it and this woman is going to end up with egg on her face!

he is a gifted tennis player who happens to be nuerodivergent. That he has achieved the position of a world class player is a testament to his talent and application abd I think that should’ve recognised

Considering no one knew who she was, but now people might know who she is, isnt she the one bringing it to everyones attention

She would have to prove that the words used would have defamed her character, not possible if hardly anyone knows who she is.

Neurodivergent in what way, but in any case what has that got to do with his anti social behaviour? Are you saying that if he has a diagnosis for 'something' it excuse his behaviour or that its to be expected?

I can’t see how she can quantify the “serious harm” aspect of her suit as no one knew who she was as a result of what NK said, only because she went to the papers and said it was her. All that happened was she got chucked off centre court, given water and let back in.

My prediction: Will get thrown out. That's not defamation... I listen to a lot of legal podcasts. It's obviously an opinion, when one says "looks like".

Now, if he said for a fact that she had consumed 700 drinks AND she could show she was harmed by this statement (reputational damage, because lawyers shouldn't be alkies maybe) then she might get somewhere. I'm suspect there's a further legal threshold that it has to be reasonable to audience to believe he could possibly know for a fact what she drank. In that context, she's a random person spectating, the listener might easily figure out it was a guess (opinion) not statement of fact. Even more not defamation.

Anyway, "Looks like" : no way. Not that alone. 2 wrongs don't make a right & she has a lousy lawyer if her lawyer is encouraging her to pursue this.

Presumably she wasn't named by him, he could hardly have known her name? So it's her own self publicity that has caused a 'loss' if any.

He's no angel though, I don't think that there has been any declaration of neuro diversity, not that that excuses some of his abhorrent behaviour court side.
