Criminal court cases this autumn

Hello all

Posting here for traffic

Just wondering if anyone has any idea regarding the barrister strikes and delays this autumn?

My abuser ex is up for attempted murder
I am wondering if the case set for oct will go ahead????

The strike has only just been confirmed so I think it’s impossible to know which cases will be affected. Am a police detective and none of us with cases coming up know anything yet.

It must be such a worry, I’m sorry.

The reality is that from Monday most cases now won't go ahead.

There will always be exceptions as it is down to each defence barrister to make that call in each case.

My best guess is that this will last (at least) for all of September.

So at least a 4 week delay?

Gosh it is hard

I don't blame them they are right to do so but it is all a mess

It's tricky as (for example) let's say a trial was due to start on 5/9 and the strike is called off by 3/10. The 5/9 trial would have to be re-fixed, likely at some incredible point in the future (as there would be a different trial set to start on 3/10, etc).

Listings are able to juggle and it depends who is in custody and on bail, but yes, unfortunately there is no certainty at the moment about what can be tried and when.

I akso understand and support the barristers strike. The legal system is on its knees.

However, just had a trial date confirmed for someone I know. August 2023!! And they have already been on remand for 8 months.

Despite having a strong defence the thought of having to spend another year on remand is seriously tempting them to plead guilty, just to get the whole thing over with ... and that is no kind of justice for anyone.

Read earlier that some cases realistically will now be set for autumn 2023 instead of taking place in a few months

I work at a Crown Court the system has got worse since George Osborne's austerity measures. The Courts , the CPS and the Police have all suffered from cuts to finances and personnel. Judges are having to reduce their hours sitting in Courts. Many Courts have been closed for good and Court buildings are in a poor state of repair. Before Covid it took on average 2-3 years for trials to be heard at the Court where I am based. Barristers are leaving the Criminal Justice System. All of this under the so called party of Law and Order.

If you care about Criminal Justice don't vote Tory.

It may get be delayed but if he is on remand they will have a time limit within which to bring the case before the court. I am not sure how cases are prioritised. Keep in touch with the Police, in particular the Officer in the Case. If you have been contacted by Witness Care and have the name of the case worker you can ask them. Also when the time comes contact the Witness Service. They can give you a pre-trial visit to the court, show you the court room, witness area and talk you through the process. They will also support you at the trial. I hope you hear soon.
