Pissed off with parking ticket

Stopped where prohibited (on red route or clearway) thats what it said on the notice.
I was there for about max 5 mins before i realised, then OH moved it when he saw other people with a parking notice on their cars. Like i say there was no notice stuck on my car when OH went. I just recieved a letter this moring with the notice saying i need to pay the fine. The actual sign there was quite misleading as it said it was ok to park after 6pm. There was quite a few people there who were arging with the parking attendant who were parked before us who got tickets.

There was no ticket on the car

But you have stated you realised you'd parked where you shouldn't have. There will probably have been CCTV thats recorded you.

If you want to argue your case, take a picture of the sign saying parking after 6pm was ok and state the time you parked as that will have also been recorded.

Did you park after 6pm? If so no prob. If not you've incurred a fine and need to pay.

You parked on a prohibited road, everyone else got tickets, and you somehow think you should be exempt? Yeah, good luck with that.

Actually I'm not saying I should be exempt.
Incase I wasn't clear what I'm asking is can they actually give me a notice if I wasnt given a ticket.

I never took any photos as I didn't see the need to because there was no ticket onthe car

Of course they can. It's done with cameras and tech.

Red zones are monitored like bus lanes. You get a notice through the post not a ticket on the car.

If you think the zone was in any way ambiguous go back, take a picture of the plate and query the notice.

Yes, I get you, and I can't account for the disparity, but I don't think that's a legal defence for you.

I'm always so careful and haven't got a ticket in years so I'm just a little taken a back handout a dampner on my day.

Will be extra cautious in future, there goes £70 down the drain.Sad

You parked somewhere you really shouldn’t. It sucks to have a fine but you do need to be more careful.

It will probably have been anpr that recorded you, that’s why you didn’t get a ticket. You’ll have to fall on your sword and pay it.

Oh I see! Of course it has made you feel fed up but you also say you haven’t had a ticket for a long time. If you were really careful you wouldn’t ever have had one. Just be more aware in future.

If the sign says you can park after 6 and you did park after 6 then go back, take a photo and appeal it, it should be time stamped when you were parked there.

I got caught out like this twice.
I got lost down a country road that I'd didnt know. I was dropping a child off at a new foster placement and the 2nd time doing a follow up visit. It was a winter's night and the visibility was hazy.
I pulled up to put the sat nav on in what looked like a wide safe place.
A week later a photo of my car arrived with the penny notice and a few says later a 2nd one come.
I just had to suck it up but that £120 gone in an instant.

I think you can usually appeal it once without the fine increasing. If that’s the case then you may as well give it a go. If the sign said you could park there after 6, and it was after 6, then you’ll almost certainly win. I got off one recently, I actually had a permit but that part of the street was suspended and the appeal I submitted centred on inadequate signage/notification of the suspension, so that could be a route to try too if it was in anyway unclear.

You might have cause to appeal. If there is parking allowed at certain times and other cars were parked it certainly would not be unreasonable to stop to permit you to find & read the restriction plate would it as I'm sure they are a tad difficult to read at 30mph.
Moreso that you say parking is permitted after 6pm and it was after 6pm.

To avoid snatching defeat from the jaws of victory as you really only get one chance at it you'd be best posting over on forums.pepipoo.com/index.php?showforum=30 and getting proper advice on how to approach an appeal. Remember these can be won on procedural and wording cockups just as much as on the facts of the parking

I live in a London borough 90+% of tickets just arrive in the post, all done by cameras, not humans on foot or motorbikes anymore, much cheaper for the council just using CCTV.
