Accident- AIBU to question who's at fault

So car accident happened as shown n diagram. Car B in left hand lane, empty lane and green light to go around the corner. Row of static cars next to them as waiting at red light to go straight on. Car A is coming the other direction, sees a gap in the static queue and drives though it to reach the carpark, in doing so crosses the lane where Car B is. Car B couldn't stop in time and hit car Car A. AIBU unreasonable to think Car A is at fault?

Depends what speed Car B was travelling at

Darkstar4855 · 24/05/2021 14:06

Car A is at fault. B has right of way.

NavaniKholinRocks · 24/05/2021 14:08

Unless you’ve omitted some other pertinent facts (such as whether Car B was speeding etc.) then it was Car A’s fault.

thestarvingcaterpillar · 24/05/2021 14:08

Definitely Car A at fault Car B has right of way, I take it that you're car B OP?

WingingItEveryDay7 · 24/05/2021 14:10

I would argue that car A is to blame here. Car B was proceeding correctly in their lane (assuming doing the limit or less). Car A does not have right of way here and should have made sure the lane was clear before crossing it. This exact situation happened with my BIL driving car A a few years back. Was found at fault straight away!

Herbie0987 · 24/05/2021 14:11

Car B has hit car A, as per the diagram.

TheQueef · 24/05/2021 14:13

Car A was crossing an active lane?

EnglishRain · 24/05/2021 14:13

YANBU. Car A should have given way.

Taxiparent · 24/05/2021 14:15

Car A is at fault. I had an accident in exactly the same situation a few years ago. As I had the right of way and my lane was clear to proceed the accident was ruled in my favour.

rwalker · 24/05/2021 14:16

Car a was at fault crossing a live lane with something coming .

Go on which one are you ?

cookiemonster5 · 24/05/2021 14:17

A is at fault. B couldn't see because of the traffic to their right and A should have checked their path was clear before entering the lane.

LakieLady · 24/05/2021 14:17

Unless B was speeding, car A was at fault.

Not only does traffic in the active lane have right of way over turning traffic, but the driver of car A was turning into a gap between stationary vehicles, so should have been going very cautiously as they couldn't see what was coming along the lane where B was.

ChicChaos · 24/05/2021 14:18

Have the insurers said it's a 50/50 because Car B was speeding? I'd say B has the right of way, surely it's irrelevant whether the turn light was on green or not? Had B just pulled out of the line of traffic or turned out of a side road?

DistrictCommissioner · 24/05/2021 14:19

Same thing happened to my dad recently (he was car B) - car A was at fault.

WeAreTheHeroes · 24/05/2021 14:20

This exact thing happened to DP a few years ago. He had to really fight the insurance company who wanted to go 50:50 on liability, but he stuck up for himself. Unfortunately his car was written off.

CuriousaboutSamphire · 24/05/2021 14:23

Even if Car B was speeding and that traffic light was on red Car A is at fault. They are the ones crossing lanes, making a maneouvre.

If it were me in Car B and my insurers even whispered 50:50 or similar I would shout long and loud.

BigPyjamas · 24/05/2021 14:27

Car A at fault for me.

B driving in own Lane doing nothing wrong, A was making a manoeuvre and didn't check adequately.

steppemum · 24/05/2021 14:27

dh had a small accident recently.
Van opened his door as dh was driving past and smashed the side of our car.
100% other car's fault, photographic evidence to prove it. Van said door was already open, photos prove otherwise. Both cars insured by same company, and they decided 50:50, as it made not one iota of difference to them.
I think that you have to fight insurance companies lazy lack of incentive to allocate balme.

Mochudubh · 24/05/2021 14:32

Looks like A isn't familiar with the road layout and didn't realise they were crossing two lanes or that the inside lane was moving. Definitely A at fault.

steppemum · 24/05/2021 14:33

sorry, meant to say definitely car A but getting insurance to accept that is hard

LIZS · 24/05/2021 14:33

A , B had row and A needed to check both lanes were clear before starting to cross.

SingingSands · 24/05/2021 14:34

Car A is at fault

Noshowlomo · 24/05/2021 14:38

A

FloodgatesofHell · 24/05/2021 14:43

Car A at fault. B should have waited, or looked harder

Retrievemysanity · 24/05/2021 14:45

Definitely car A at fault.
